Establishment of board
Sec. 1. The behavioral health and human services licensing boardis established.

Membership of board; qualifications; political affiliation
Sec. 2. (a) The board consists of eleven (11) members appointedby the governor for terms of three (3) years. The board must includethe following:
(1) Two (2) marriage and family therapists who:
(A) have at least a master's degree in marriage and familytherapy or a related field from an eligible postsecondaryeducational institution;
(B) are licensed under this chapter; and
(C) have five (5) years of experience in marriage and familytherapy.
(2) One (1) social worker who:
(A) has at least a master's degree in social work from aneligible postsecondary educational institution accredited bythe Council on Social Work Education;
(B) is licensed under this article; and
(C) has at least five (5) years of experience as a socialworker.
(3) One (1) social services director of a hospital with a socialwork degree who has at least three (3) years of experience in ahospital setting.
(4) Two (2) mental health counselors who:
(A) have at least a master's degree in mental healthcounseling;
(B) are licensed under this article; and
(C) have at least five (5) years experience as a mental healthcounselor.
(5) Two (2) consumers who have never been credentialed underthis article.
(6) One (1) physician licensed under IC 25-22.5 who hastraining in psychiatric medicine.
(7) Two (2) licensed clinical addiction counselors who:
(A) are licensed under IC 25-23.6-10.5; and
(B) have at least five (5) years experience in clinicaladdiction counseling.
(b) Not more than six (6) members of the board may be from thesame political party.

Per diem, travel, and other expenses
Sec. 3. Each member of the board who is not a state employee isentitled to the minimum salary per diem provided byIC 4-10-11-2.1(b). Each member of the board is entitled toreimbursement for travel expenses and other expenses actuallyincurred in connection with the member's duties, as provided in thestate travel policies and procedures established by the department ofadministration and approved by the budget agency.

Removal of governor appointed member
Sec. 4. A member of the board who is appointed by the governormay not be removed from the board except by action of the governor.

Chairman; term
Sec. 5. The board shall elect a chairman from among the membersof the board for a one (1) year term. An individual may not beelected as chairman for more than two (2) consecutive one (1) yearterms.

Meetings
Sec. 6. The board shall meet at least one (1) time each year.

Duties of board
Sec. 7. The board shall consider matters that are of interest to allboard sections.

Adoption of standards; fees; duties of board
Sec. 8. (a) The board shall adopt rules under IC 4-22-2establishing standards for the following:
(1) The competent practice of marriage and family therapy,social work, clinical social work, mental health counseling,addiction counseling, and clinical addiction counseling.
(2) The renewal of licenses issued under this article. (3) Standards for the administration of this article.
(4) Continuing education requirements for an individual seekingrenewal of licensure as a social worker, clinical social worker,or marriage and family therapist.
(5) The retention of patient records and reports by a counselor.
(6) The approval of continuing education providers, programs,courses, fees, and proof of course completion.
(b) The board shall establish fees under IC 25-1-8-2.
(c) The board shall do the following:
(1) Consider the qualifications of individuals who apply for alicense under this article.
(2) Provide for examinations required under this article.
(3) Subject to IC 25-1-8-6, renew licenses under this article.
(4) Conduct proceedings under IC 25-1-9.

Social worker section established
Sec. 9. (a) The social worker section of the board is established.The section consists of the following:
(1) Two (2) social worker members of the board.
(2) Two (2) consumer members of the board.
(3) One (1) physician member of the board.
(b) Three (3) members of the social worker section, two (2) ofwhom must be social workers, constitute a quorum.

Addiction counselor section of board established
Sec. 9.5. (a) The addiction counselor section of the board isestablished. The section consists of the following:
(1) Two (2) licensed clinical addiction counselor members ofthe board.
(2) Two (2) consumer members of the board.
(3) One (1) physician member of the board.
(b) Three (3) members of the addiction counselor section, two (2)of whom must be addiction counselors, constitute a quorum.

Marriage and family therapist section established
Sec. 10. (a) The marriage and family therapist section of the boardis established. The section consists of the following:
(1) Two (2) marriage and family therapist members of theboard.
(2) Two (2) consumer members of the board.
(3) One (1) physician member of the board. (b) Three (3) members of the marriage and family therapistsection, two (2) of whom must be marriage and family therapists,constitute a quorum.

Sec. 10.5. (a) The mental health counselor section of the board isestablished. The section consists of the following:
(1) Two (2) mental health counselor members of the board.
(2) Two (2) consumer members of the board.
(3) One (1) physician member of the board.
(b) Three (3) members of the mental health counselor section, two(2) of whom must be mental health counselors, constitute a quorum.

Duties of sections of the board
Sec. 11. The social worker, marriage and family therapist, mentalhealth counselor, and addiction counselor sections of the board shalldo the following:
(1) Approve continuing education courses authorized under thisarticle.
(2) Propose rules to the board concerning the practice of theprofession regulated by each section.
(3) Other duties as directed by the board.

Examinations; testing company services
Sec. 12. The board may utilize the services of a testing companyto prepare, conduct, and score examinations.
