    Chapter 2. Board of Podiatric Medicine

Establishment of board
    
Sec. 1. The board of podiatric medicine is established.

Membership of board; qualifications
    
Sec. 2. (a) The board consists of six (6) members appointed by thegovernor.
    (b) Four (4) members must be licensed podiatrists who activelypractice podiatric medicine and who meet the following conditions:
        (1) Be licensed in Indiana as a podiatrist under this article.
        (2) Be a resident of Indiana.
        (3) Have practiced podiatric medicine for at least five (5) years.
    (c) Two (2) members of the board must meet the followingconditions:
        (1) Be a resident of Indiana.
        (2) Not be associated with the practice of podiatry other than asa consumer.

Term of members
    
Sec. 3. A member of the board serves a term of three (3) years anduntil the member's successor is appointed and qualified.

Removal of member; filling vacancies
    
Sec. 4. (a) The governor may remove a member of the board aftera hearing conducted under IC 4-21.5-3 for incompetency, neglect ofduty, or for unprofessional conduct.
    (b) A vacancy in the membership of the board shall be filled byappointment by the governor for the unexpired term.

Quorum
    
Sec. 5. A quorum of the board consists of four (4) members. Atleast four (4) votes are necessary for the board to take official action.

Meetings
    
Sec. 6. (a) The board shall hold at least one (1) meeting each year.The board may hold additional meetings that the board considersnecessary.    (b) A meeting may be called by the chairman or by a majority ofthe members of the board.

Officers
    
Sec. 7. Each year the board shall elect a chairman and any otherofficers from its members that the board considers necessary.

Compensation and reimbursement
    
Sec. 8. Each member of the board is entitled to receive theminimum salary per diem provided by IC 4-10-11-2.1(b). Themember is also entitled to reimbursement for traveling and expensesas provided under IC 4-13-1-4 and other expenses actually incurredin connection with the member's duties as provided in the statepolicies and procedures prepared by the Indiana department ofadministration and approved by the budget agency.

Records
    
Sec. 9. The agency shall keep a record of all licenses andapplications for licensure. The record must contain all the facts in theapplication, including the action of the board on the application.

Receipts and deposits
    
Sec. 10. The agency shall receive and account for all moneycollected under this article and deposit the money in the state generalfund with the treasurer of state.

Adoption of rules
    
Sec. 11. (a) The board may adopt rules under IC 4-22-2concerning the following:
        (1) Forms necessary for applications.
        (2) Creation of a committee to assist the board with theadministration of podiatrist's assistants and supervisingpodiatrists under IC 25-29-8.
        (3) Areas that are necessary to implement this act.
    (b) The board shall adopt rules under IC 4-22-2 concerning thefollowing:
        (1) The establishment of fees under IC 25-1-8-2.
        (2) The retirement or surrender of a license.        (3) Granting an inactive license and procedures forreinstatement of an inactive license.

Conduct of hearings
    
Sec. 12. Each hearing conducted by the board must be held inaccordance with the procedures under IC 4-21.5-3.
