Sec. 3. A person must file a verified application for a manicuristlicense with the board on a form prescribed by the board to obtainthat license.

Contents of application
Sec. 4. The application described in section 3 of this chapter muststate that the applicant:
(1) is at least eighteen (18) years of age;
(2) has successfully completed the eighth grade or received theequivalent of an eighth grade education;
(3) has graduated from a manicurist program in a cosmetologyschool;
(4) has received a satisfactory grade (as defined by IC 25-8-4-9)on an examination for manicurist license applicants prescribedby the board;
(5) has not committed an act for which the applicant could bedisciplined under IC 25-8-14; and
(6) has paid the fee set forth in IC 25-8-13-9 for the issuance ofa license under this chapter.

Unsuccessful examination; consequences
Sec. 5. If a person does not receive a satisfactory grade on theexamination described in section 4(4) of this chapter, the person mayrepeat the examination subject to the rules governing the examinationthat are adopted by the board.

IC 25-8-11-6 Unsuccessful repeat examination; consequences
Sec. 6. If a person does not receive a satisfactory grade on therepeat examination described in section 5 of this chapter, the boardmay:
(1) refuse to permit that person to take the examination again;or
(2) permit the person to take the examination again, subject tothe rules governing the examination adopted by the board.

Use of acrylic liquid monomer formulated with methylmethacrylate
Sec. 7. (a) A person licensed under this article may not use acrylicliquid monomer formulated with methyl methacrylate (MMA).
(b) A person who violates subsection (a) may be disciplined underIC 25-1-11.

Provisional license; manicurist
Sec. 8. (a) This section applies only to applications for amanicurist license under this article.
(b) If an applicant comes from a jurisdiction that does not issue amanicurist license, the board may issue an initial provisional licenseto an applicant who meets the following requirements:
(1) The board finds that the applicant has sufficient training orexperience as a manicurist.
(2) The applicant has not committed an act that wouldconstitute a violation of the standards of practice underIC 25-1-11.
(3) The applicant pays a fee established by the board underIC 25-1-8.
(c) An applicant who has been granted an initial provisionallicense must work under the supervision of a licensed cosmetologistor licensed manicurist.
(d) A person who holds an initial provisional license may applyfor renewal of a manicurist license under this chapter.
(e) The holder of a provisional license may petition the board forthe issuance of a manicurist license to practice without supervision.The holder of a provisional license who demonstrates to the boardthat the holder may satisfactorily practice without supervision shallbe released from the terms of the provisional license and is entitledto hold a license under this chapter.
