Sec. 1. The board may license a person to be an esthetician.

Verified application; filing; form
Sec. 3. A person must file a verified application for an estheticianlicense with the board on a form prescribed by the board to obtainthe license.

Licensee qualifications
Sec. 4. To receive a license issued under this chapter, a personmust:
(1) be at least eighteen (18) years of age;
(2) have successfully completed the tenth grade or received theequivalent of a tenth grade education;
(3) have graduated from an esthetics program in a cosmetologyschool;
(4) have received a satisfactory grade (as defined byIC 25-8-4-9) on an examination for esthetician licenseapplicants prescribed by the board;
(5) not have committed an act for which the person could bedisciplined under IC 25-8-14; and
(6) pay the fee set forth in IC 25-8-13-11 for the issuance of alicense under this chapter.

Unsuccessful examination; consequences
Sec. 5. If a person does not receive a satisfactory grade on theexamination described in section 4(a)(4) of this chapter, the personmay repeat the examination subject to the rules governing theexamination that are adopted by the board.

Repeat examination; unsatisfactory grade
Sec. 6. If a person does not receive a satisfactory grade on therepeat examination described in section 5 of this chapter, the boardmay:
(1) refuse to permit the person to take the examination again; or
(2) permit the person to take the examination again, subject tothe rules governing the examination adopted by the board.

Provisional license; esthetician
Sec. 8. (a) This section applies only to applications for anesthetician license under this article.
(b) If an applicant comes from a jurisdiction that does not issue anesthetician license, the board may issue an initial provisional licenseto an applicant who meets the following requirements:
(1) The board finds that the applicant has sufficient training orexperience as an esthetician.
(2) The applicant has not committed an act that wouldconstitute a violation of the standards of practice underIC 25-1-11.
(3) The applicant pays a fee established by the board underIC 25-1-8.
(c) An applicant who has been granted an initial provisionallicense must work under the supervision of a licensed cosmetologistor a licensed esthetician.
(d) A person who holds an initial provisional license may applyfor renewal of an esthetician license under this chapter.
(e) The holder of a provisional license may petition the board forthe issuance of an esthetician license to practice without supervision.The holder of a provisional license who demonstrates to the boardthat the holder may satisfactorily practice without supervision shallbe released from the terms of the provisional license and is entitledto hold a license under this chapter.
