    Chapter 12.6. Esthetician Shop License

Licensure by board
    
Sec. 1. The board may issue a license to operate an esthetic salon.

Qualifications for license
    
Sec. 2. To obtain an esthetic salon license, a person must:
        (1) select a site for the salon that, if located in the same buildingas a residence:
            (A) is separated from the residence by a substantial partition;and
            (B) has a separate entry;
        (2) obtain a building permit, certificate of occupancy, or otherapproval action required under IC 22-12 and IC 36-7-4 tooperate the esthetic salon;
        (3) install the furnishings and obtain the salon equipmentrequired under rules adopted by the board; and
        (4) submit a verified statement on a form prescribed by theboard that the esthetic salon will be under the personalsupervision of a person who holds an esthetician license underIC 25-8-12.5 and has at least six (6) months of activeexperience as an esthetician under IC 25-8-12.5 or as acosmetologist under IC 25-8-9 before the application wassubmitted under this chapter.

Waiver of shop license requirement
    
Sec. 3. The requirement for an esthetic salon license under section2(4) of this chapter may be waived by the board if:
        (1) the applicant submits a verified petition for the waiver on aform prescribed by the board that:
            (A) states the reasons for requesting the waiver; and
            (B) is signed by two (2) persons who know the applicant andare familiar with the facts set forth in the petition; and
        (2) the board determines that the requirement would result inextreme hardship to the applicant if enforced.

Issuance of license; applicant compliance and payment of fee
    
Sec. 4. The board may issue a license under this chapter if theapplicant has:        (1) complied with section 2 of this chapter; and
        (2) paid the fee for the license set forth in IC 25-8-13-5.

Temporary license
    
Sec. 5. If:
        (1) the board cannot determine whether an applicant hascomplied with section 2 of this chapter at the time theapplication is filed; and
        (2) the board determines that the board will require more thanfifteen (15) days to determine if the applicant has complied withsection 2 of this chapter;
the board shall issue a temporary esthetic salon license to theapplicant.

Validity term of temporary license
    
Sec. 6. A temporary license issued under section 5 of this chapteris valid until the earlier of:
        (1) the date the board approves or denies the application for alicense under this chapter; or
        (2) three (3) months from the date the temporary license isissued.

Exemption from licensure
    
Sec. 7. The board may not require an esthetician to obtain alicense under this chapter if the esthetician has leased or subleaseda portion of a cosmetology salon:
        (1) from a cosmetologist licensed under IC 25-8-7; and
        (2) that meets the requirements of section 2(3) of this chapter.

Display of sign
    
Sec. 8. (a) A person holding a license issued under this chaptershall display a sign complying with standards prescribed by the boardat the main public entrance to the esthetic salon.
    (b) The sign must:
        (1) be clearly visible to a customer entering the establishmentat the entrance; and
        (2) state in legible printing that the establishment is an estheticsalon.
