Chapter 5. Enforcement and Administration

Bail bond enforcement and administration fund; creation; depositand use of funds
Sec. 1. (a) The bail bond enforcement and administration fund iscreated. All fees and penalties collected by the commissioner underthis article shall be paid into the fund to be utilized for theenforcement and administration of this article. The fund shall beadministered by the commissioner.
(b) Any balance remaining in the fund at the end of a state fiscalyear does not revert to the state general fund. The treasurer of stateshall invest the money in the fund not currently needed to meet theobligations of the fund in the same manner as other public funds maybe invested.

Bail bond enforcement and administration fund; use of money
Sec. 2. The money in the fund created by this chapter shall beused for the following purposes and no other:
(1) The employment of a qualified investigator andinvestigation staff.
(2) The expense of examination.
(3) Licensing.
(4) Forms.
(5) Other related expenses necessitated by this article.

Investigator; qualifications; staff; duties
Sec. 3. (a) The commissioner shall appoint a qualified investigatorwho shall serve at the pleasure of the commissioner. The investigatorshall be of good moral character, have had at least five (5) years ofexperience as an insurance or private investigator or equivalentexperience as a law enforcement or judicial officer, and bethoroughly familiar and conversant with Indiana criminal law,including the court procedure and structure.
(b) The investigator, with the approval of the commissioner, mayselect such staff as is necessary to enable the investigator to properlyperform the investigator's duties. The primary duty of the investigatorand the investigator's staff is to administer this article and toinvestigate all violations of this article and to report and recommendto the commissioner all findings made on the investigation.
