Determination of liabilities
    Sec. 1. When determining its liabilities, a health maintenanceorganization shall include an amount estimated in the aggregate toprovide:
        (1) for any unearned premium;
        (2) for the payment of all claims for health care expenditures,whether reported or unreported:
            (A) that have been incurred;
            (B) that are unpaid; and
            (C) for which the organization is or may be liable; and
        (3) for the expense of adjustment or settlement of claimsdescribed in subdivision (2).

Computation of liabilities
    Sec. 2. The liabilities of a health maintenance organization mustbe computed:
        (1) in accordance with rules adopted by the commissioner; and
        (2) upon reasonable consideration of the ascertained experienceand character of the health maintenance organization.
