    Chapter 3. Issuance of Certificates of Authority

IC 27-13-3-1
Satisfaction of requirements
    
Sec. 1. After receiving a completed application, the commissionershall issue a certificate of authority to operate a health maintenanceorganization to the applicant if:
        (1) the application fee is received by the commissioner; and
        (2) the commissioner is satisfied that the followingrequirements are met:
            (A) The persons responsible for the conduct of the affairs ofthe applicant are competent, trustworthy, and have goodreputations.
            (B) The health maintenance organization will effectivelyprovide or arrange for the provision of the health careservices covered in the health maintenance organization'sindividual and group contracts on a prepaid basis, throughinsurance or other means, except to the extent of reasonablerequirements for copayments and deductibles.
            (C) The health maintenance organization complies withIC 27-13-12 through IC 27-13-19.

Approval of certificate of authority
    
Sec. 1.5. (a) Except as provided in subsection (b), a completedapplication for a certificate of authority is considered approved onehundred twenty (120) days after the completed application issubmitted to the commissioner.
    (b) If the commissioner issues an order under IC 27-13-24-3(b)within one hundred twenty (120) days after a completed applicationis submitted under subsection (a), the review and processing of theapplication are subject to IC 27-13-24-3 and IC 27-13-24-4.

Denial of application
    
Sec. 2. An application for a certificate of authority may be deniedonly after the commissioner complies with the requirements set forthin IC 27-13-24.
