    Chapter 10. Suspension or Revocation of Registration

Findings to suspend or revoke a registration
    
Sec. 1. The department may suspend or revoke a discount medicalcard program organization's registration or order compliance if thedepartment finds any of the following:
        (1) The discount medical card program organization is not incompliance with this article.
        (2) The discount medical card program organization is not incompliance with the financial requirements of IC 27-17-9.
        (3) The discount medical card program organization has:
            (A) advertised, marketed, or attempted to market thediscount medical card program organization's services insuch a manner as to misrepresent the discount medical cardprogram organization's services or capacity for service; or
            (B) engaged in deceptive, misleading, or unfair practiceswith respect to advertising or marketing.
        (4) The discount medical card program organization is notfulfilling the discount medical card program organization'sobligations as a discount medical card program organization.
        (5) The continued operation of the discount medical cardprogram organization would be hazardous to the discountmedical card program organization's cardholders.

Notification; hearing
    
Sec. 2. If the department has cause to believe that grounds for thesuspension or revocation of a registration under this article exist, thedepartment shall:
        (1) notify the discount medical card program organization inwriting specifically stating the grounds for suspension orrevocation; and
        (2) pursue a hearing under IC 4-21.5.

Conclude affairs; prohibited activity
    
Sec. 3. Upon the effective date of the surrender or revocation ofa discount medical card program organization's registration, thediscount medical card program organization shall conclude thediscount medical card program organization's affairs transacted underthe registration. The discount medical card program organizationmay not engage in any further advertising, solicitation, collection ofconsideration, or renewal of agreements.

IC 27-17-10-4 Suspension; specifications; rescind or modify; reinstatement
    
Sec. 4. (a) If the department suspends the registration of adiscount medical card program organization, the department mustspecify in the order of suspension the:
        (1) period during which the suspension is in effect; and
        (2) conditions that must be met by the discount medical cardprogram organization before the registration is reinstated.
    (b) An order of suspension may be rescinded or modified byfurther order of the department before the expiration of thesuspension period specified under subsection (a).
    (c) The department may not reinstate a suspended registrationunless reinstatement is requested by the discount medical cardprogram organization.
    (d) The department may not reinstate a suspended registration ifthe department determines that the circumstances for which thesuspension occurred continue to exist or are likely to recur.

Suspension; requirements
    
Sec. 5. On the date that a discount medical card programorganization receives notice from the department that the discountmedical card program organization's registration is suspended, thediscount medical card program organization shall:
        (1) cease to enroll new cardholders;
        (2) honor discounts for existing cardholders for expensesincurred before and on the date of suspension;
        (3) discontinue collection of fees from existing cardholdersafter the date of suspension; and
        (4) refund fees collected from existing cardholders after thedate of suspension.
