Chapter 13. Required Notice of Flood Coverage in a ResidentialPolicy

Applicability of chapter; exceptions
Sec. 1. (a) This chapter applies to policies of insurance coveringrisks to property located in Indiana that are issued or renewed afterDecember 31, 2001, and that insure against loss of or damage to:
(1) real property consisting of not more than four (4) residentialunits, one (1) of which is the principal place of residence of thenamed insured; or
(2) personal property:
(A) in which the named insured has an insurable interest;and
(B) that is used within a residential dwelling for personal,family, or household purposes.
(b) This chapter does not apply to the following:
(1) A policy of inland marine insurance.
(2) An automobile insurance policy under IC 27-7-6.
(3) A commercial property and casualty insurance policy underIC 27-1-31.

Required notices for policies not covering flood damage
Sec. 2. If a policy of insurance described in section 1 of thischapter does not provide coverage for flood damage:
(1) the policy jacket must contain a prominently printed noticestating; or
(2) the policyholder must be given written notice when thepolicy is issued, or upon the first renewal after December 31,2001;
that coverage for flood damage may be available through theNational Flood Insurance Program.
