Certification
    
Sec. 1. (a) Whenever a proposed state constitutional amendmentor other public question is submitted by the general assembly underArticle 16 of the Constitution of the State of Indiana to the electorateof the state for a popular vote, the election division shall certify thepublic question to the county election board of each county.
    (b) If the vote is to occur at a general election, the electiondivision shall certify by noon August 20 before the election. If aspecial election is to be held, the election division shall certify atleast thirty (30) days before the election. Each county election boardshall publish notice of the public question in accordance withIC 5-3-1.

Form of public question on ballot; effect of failure to vote
    
Sec. 2. (a) This subsection applies if the general assembly doesnot prescribe the form in which a state constitutional amendmentmust appear on the general election ballot. If the electorate of thestate may vote on a state constitutional amendment or other publicquestion, the commission shall prepare a brief statement of the publicquestion in words sufficient to clearly designate it and have thestatement printed on the state ballot in the form prescribed byIC 3-11-2-15.
    (b) If a voter does not vote on the public question, the ballot isvoid with regard to the public question and may not be counted.

Marking of ballots; application of general election laws
    
Sec. 9. Except as provided in this chapter, all of the provisions ofthis title concerning the marking and counting of ballots forcandidates that are consistent with this chapter apply to the markingand counting of votes for a state constitutional amendment.
