Chapter 8. The Voter's Bill of Rights

Commission to prescribe statement of voter's bill of rights
Sec. 1. The commission shall prescribe a statement of the rightsof a voter in Indiana that shall be known as "the voter's bill of rights".

Content of statement of bill of rights
Sec. 2. The statement required by section 1 of this chapter mustcontain the following:
(1) A statement of the qualifications that an individual mustmeet to vote in Indiana, including qualifications relating toregistration.
(2) A statement describing the circumstances that permit a voterwho has moved from the precinct where the voter is registeredto return to that precinct to vote.
(3) A statement that an individual who meets the qualificationsand circumstances listed in subdivisions (1) and (2) may vote inthe election.
(4) A statement describing how a voter who is challenged at thepolls may be permitted to vote.
(5) The date of the election and the hours during which the pollswill be open, as required by 42 U.S.C. 15482.
(6) Instructions on how to vote, including how to cast a voteand how to cast a provisional ballot, as required by 42 U.S.C.15482.
(7) Instructions for mail-in registrants and first time votersunder IC 3-7-33-4.5 and 42 U.S.C. 15483, as required under 42U.S.C. 15482.
(8) General information on voting rights under applicablefederal and state laws, including the right of an individual tocast a provisional ballot and instructions on how to contact theappropriate officials if these rights are alleged to have beenviolated, as required under 42 U.S.C. 15482.
(9) General information on federal and state laws regardingprohibitions on acts of fraud and misrepresentation, as requiredunder 42 U.S.C. 15482.
(10) A statement informing the voter what assistance isavailable to assist the voter at the polls.
(11) A statement informing the voter what circumstances willspoil the voter's ballot and the procedures available for the voterto request a new ballot.
(12) A statement describing which voters will be permitted tovote at the closing of the polls.
(13) Other information that the commission considers importantfor a voter to know.

Absentee voter's bill of rights; prescribed by commission
Sec. 2.5. (a) The commission shall prescribe a statement knownas the "Absentee Voter's Bill of Rights".
(b) The Absentee Voter's Bill of Rights must be in a formprescribed by the commission and include the following:
(1) A statement summarizing the rights and responsibilities ofthe voter when casting and returning the absentee ballot.
(2) A summary of Indiana and federal laws concerningproviding assistance to the voter, completion of the ballot insecret, intimidation of voters, and the return of the absenteeballot to the county election board.
(3) Information concerning how to report violations of theabsentee ballot and election laws.

Posting of voter's bill of rights; distribution of voter's bill of rightswith election information
Sec. 3. (a) As required by 42 U.S.C. 15483, the precinct electionboard shall post the voter's bill of rights in a public place in eachpolling place on election day.
(b) The commission may require a copy of the voter's bill of rightsto be distributed with voter registration materials or other materialsthat are given to voters.

Posting voter's bill of rights on the Internet
Sec. 4. The secretary of state or other state agency postingelection information on the state's Internet site shall include thevoter's bill of rights on the site.

Publication of voter's bill of rights in news media
Sec. 5. Not later than thirty (30) days before a primary, general,or municipal election, the secretary of state shall request Indiananews media to include a copy of the voter's bill of rights as part ofelection coverage or in public service announcements.
