    Chapter 21. Procedures for Designating Additional VoterRegistration Offices; County NVRA Implementation Plans

Purpose of chapter
    Sec. 1. This chapter prescribes the procedure for designatingadditional federal and nongovernmental offices as voter registrationagencies under 42 U.S.C. 1973gg-5(a)(3)(B)(ii).

Filing of implementation plan
    Sec. 2. Each county election board shall file the county's NVRAimplementation plan adopted under IC 3-6-5-14 with the electiondivision.

Additional offices designated
    Sec. 3. A county NVRA implementation plan may recommendthat additional federal, state, and local governmental offices (ornongovernmental offices) within the county be designated as voterregistration agencies.

Duties of commission in reviewing implementation plan
    Sec. 4. The commission shall review each county NVRAimplementation plan and determine the following:
        (1) Whether the voter registration agencies located within thecounty will adequately implement the legislative findings andpurposes set forth in NVRA and this article.
        (2) Whether designating an office recommended as a voterregistration agency under section 3 of this chapter willimplement the legislative findings and purposes.

Amendment to county NVRA implementation plan; designation ofvoter registration agency
    Sec. 5. (a) If the commission determines that the voter registrationagencies located within the county will not adequately implementNVRA or this article, the commission shall recommend anamendment to the county NVRA implementation plan to ensure thatNVRA and this article are adequately implemented.
    (b) Unless the county election board files a written protest withthe NVRA official not later than noon thirty (30) days after thecommission recommends the plan amendment, the plan is amended

as provided in the recommendation. A written protest under thissubsection is referred to the commission for final determination.
    (c) If recommended in the county NVRA implementation plan:
        (1) as filed under section 2 of this chapter; or
        (2) as amended under subsection (b);
the county election board shall enter into an agreement to designatean office described in the plan as a voter registration agency. Anagreement under this subsection is subject to review and approval bythe commission.

Governing body
    Sec. 6. For the purposes of this chapter, the officer, board, entity,or agency that has the authority to enter into an agreement with thecounty election board is the "governing body" under IC 3-17-18.

Office to be provided
    Sec. 7. An agreement under this chapter must provide for anoffice to accept and process voter registration applications asprovided in IC 3-7-18.
