Chapter 22. Mail Registration

Purpose of chapter
Sec. 1. This chapter prescribes procedures for voter registrationby mail as provided in 42 U.S.C. 1973gg-4 and 42 U.S.C. 15483.

Use of form prescribed by federal Election Assistance Commission
Sec. 2. As provided in 42 U.S.C. 1973gg-4(a)(1) and 42 U.S.C.15483, a county voter registration office shall accept and use the mailvoter registration form prescribed by the federal Election AssistanceCommission under 42 U.S.C. 1973gg-7(a)(2).

Use of form prescribed by commission
Sec. 3. As provided in 42 U.S.C. 1973gg-4(a)(2) and 42 U.S.C.15483, a county voter registration office shall accept and use a mailvoter registration form prescribed by the commission that complieswith 42 U.S.C. 1973gg-7(b)(2), 42 U.S.C. 15483, and this article.

Information required
Sec. 4. (a) A mail registration form prescribed under section 3 ofthis chapter may only require information necessary to enable thecounty voter registration office to do the following:
(1) Assess the eligibility of the applicant, including theeligibility of the applicant under 42 U.S.C. 15483.
(2) Administer the voter registration and election process.
(b) The information required under subsection (a) may include thefollowing:
(1) The signature of the applicant.
(2) Data relating to previous registration by the applicant.
(c) The form may not include any requirement for notarization orother formal authentication.

Content of mail registration form
Sec. 5. A mail registration form prescribed under section 3 of thischapter must meet the following requirements:
(1) The form must include a statement that does the following: (A) Sets forth each eligibility requirement for registration(including citizenship).
(B) Contains an attestation that the applicant meets each ofthe eligibility requirements.
(C) Requires the signature of the applicant, under penalty ofperjury.
(2) The form must include, in print that is identical to the printused in the attestation part of the application, informationsetting forth the penalties provided by law for submission of afalse voter registration application.
(3) The question "Are you a citizen of the United States ofAmerica?" and boxes for the applicant to check to indicatewhether the applicant is or is not a citizen of the United States.
(4) The question "Will you be 18 years of age on or beforeelection day?" and boxes for the applicant to check to indicatewhether or not the applicant will be eighteen (18) years of ageon or before election day.
(5) A statement informing the individual that if the form issubmitted by mail and the individual is registering for the firsttime, the appropriate information required under 42 U.S.C.15483 must be submitted with the mail-in registration form inorder to avoid the additional identification requirements uponvoting for the first time.

Distribution of form
Sec. 6. (a) As provided in 42 U.S.C. 1973gg-4(b), the NVRAofficial shall make registration by mail forms available fordistribution, with particular emphasis on organized voter registrationprograms.
(b) The NVRA official complies with subsection (a) by ensuringthat a downloadable version of the current registration by mail formis published on the election division web site.

Appearance in person not necessary
Sec. 8. An individual who is eligible to register under this articlemay register by mail without appearing in person before a circuitcourt clerk or board of registration.

Acceptance of registration form
Sec. 9. A circuit court clerk or board of registration shall accepta registration by mail form for processing under this article wheneverthe form is presented by any of the following:
(1) The United States Postal Service.
(2) The individual registering by mail.
(3) A person presenting the form on behalf of the individualwho is registering.
