Registration record; affidavits and forms
Sec. 1. The registration affidavits or forms of each precinct are theregistration record of all voters residing in and entitled to vote in theprecinct. The registration record shall be compiled, amended,supplemented, and preserved as prescribed by this article.

Custody of property
Sec. 2. Each board of registration has custody of all registrationfacilities, equipment, supplies, forms, records (including the recordsof registered voters of the county), registration affidavits, and otherproperty used in connection with the registration of voters of thecounty.

Offices
Sec. 3. The county executive shall provide each board ofregistration with suitable offices. The offices must be:
(1) located in the county courthouse or in a building easilyaccessible to the courthouse;
(2) easily accessible to the public; and
(3) adequate to meet the needs of the board.

Record keeping; methods
Sec. 4. A circuit court clerk or board of registration may:
(1) keep records by using electronic data processing equipment;and
(2) enter into contracts for this purpose.

Records unfit to be used
Sec. 5. If the registration records of a precinct are destroyed,mutilated, inaccessible, or for any other reasonable cause, unfit to beused, as determined by the county election board of the county inwhich the precinct is located, the circuit court clerk or board ofregistration shall conduct a registration of all voters residing in theprecinct. Each voter who is a resident of the precinct must register asprovided in this article.

Ensuring accuracy; implementation of programs; records;computerized registration information
Sec. 6. (a) As required under 42 U.S.C. 1973gg-6(i), a countyvoter registration office shall retain records concerning theimplementation of programs and activities conducted for the purposeof ensuring the accuracy and currency of the voter registration list.These records include the following:
(1) Lists of names and addresses of voters who were sentnotices under the voter list maintenance program.
(2) Information concerning whether a voter has responded to anotice described by subdivision (1) as of the date the inspectionof the record is made.
(b) The county voter registration office shall retain the recordsdescribed by this section for at least two (2) years. Except for recordsconcerning declinations to register to vote or that indicate theidentity of a voter registration agency where a person registered, thecounty voter registration office shall make the records available forpublic inspection and photocopying at a reasonable cost as providedin IC 5-14-3.
(c) In accordance with IC 5-14-3-3(g) and notwithstanding anyother statute, a county voter registration office shall, with regard tovoter registration information concerning voters of the county on acomputerized system, act in accordance with a nondiscriminatoryuniform policy adopted by the county election board. The policymust either permit a person to duplicate or obtain a duplicate copy ofa computer tape, computer disc, microfilm, or other similar recordsystem that contains this voter registration information or not permitthe person to duplicate or obtain a duplicate copy of the information.
(d) A person who requests computerized voter registrationinformation under subsection (c) must provide a written statementthat the person will not:
(1) use the information to solicit merchandise, goods, services,or subscriptions; or
(2) sell, loan, give away, or otherwise deliver the informationobtained by the request to any other person;
for a purpose other than political activities or political fundraisingactivities.
(e) Publication of information obtained under subsection (d) in anews broadcast or newspaper is not prohibited.

Active voter; determination
Sec. 7. The voter registration records must indicate whether aperson is an active voter. The circuit court clerk or board ofregistration is not required to compile separate lists of active andinactive voters.

Memorandum
Sec. 8. In a county that has a board of registration, the board shallhave prepared a memorandum for each voter's original affidavit ofregistration or transfer of an original registration executed by theboard.

Contents of memorandum
Sec. 9. The memorandum must indicate the name, assignedidentification number, street and number, ward, and precinct of eachresident voter of the county who has executed an original affidavit ofregistration. For a resident voter of the county who executes atransfer of an original registration or a change of name, thememorandum must indicate the name, the assigned identificationnumber, and the former and present addresses by street and number,ward, and precinct.

Retention of memorandum
Sec. 10. The board of registration shall retain the original copiesof all memoranda or microfilmed copies of the memoranda as part ofthe board's records until disposal of the record is permitted under thisarticle after cancellation of the registration.

Availability of information
Sec. 12. Except for information declared confidential under thisarticle, the affidavits or forms must be available at reasonable timesduring regular office hours for inspection, transcription, andduplication, including photocopy duplication and microfilming, asprovided in IC 5-14-3.

Storage of affidavits or forms
Sec. 15. (a) This section does not apply to a county acting inaccordance with section 21.1 or 22 of this chapter. The county voterregistration office shall keep all original affidavits or forms ofregistration in the clerk's or board's office except when the affidavitsor forms are in the possession of the precinct election boards for useon election day at the polls. The county voter registration office shallkeep any duplicate affidavits or forms at all times in the clerk's orboard's office.
(b) If the original affidavits or forms of registration have beenmicrofilmed or recorded through a similar electronic processauthorized under IC 5, any duplicate affidavits may be:
(1) stored in a secure location outside of the office of the clerkor board; or
(2) discarded, if a microfilmed or similar electronic record ofthe duplicate affidavits is stored in a secure location outside theoffice of the clerk or board.

Arrangement in binders or card files
Sec. 16. (a) This section does not apply to a county if the countyelection board has adopted a resolution providing that affidavits orforms are not required to be delivered to the polls.
(b) The affidavits or forms shall be securely arranged in suitablebinders or card files before being delivered to the inspector of eachprecinct to be used at an election.

Municipalities
Sec. 17. The registration record used at any municipal primary ormunicipal election is that part of the registration record of the countyin which the municipality is located.

Cancellation; entry into record
Sec. 18. When a registration is canceled for any reason prescribedin this chapter, the circuit court clerk or board of registration shallhave a proper entry made on the voter registration record indicatingthe date and the cause for cancellation. The person who canceled theaffidavits or forms shall also sign the affidavits or forms.

Cancellation; disposal of affidavit or form
Sec. 19. The original canceled affidavit or form shall be filed and
preserved in the office of the clerk or board for the period requiredby this article and then transferred to the county commission ofpublic records for disposal under IC 5-15-6-7.

Computerized systems; entry of information
Sec. 20.1. (a) The county voter registration office shall prepare anentry in the computerized system that accurately reflects theinformation set forth in the original affidavit of registration.However, the county voter registration office is required to enter avoter's voting history for the previous ten (10) years only if thathistory is available.
(b) The county voter registration office is not required to preparea duplicate paper copy of a registration properly entered into thecomputerized system.

Computerized system identifying documentation for votersubmitting registration application by mail
Sec. 20.2. (a) The county voter registration office shall prepare anentry in the computerized system indicating:
(1) whether the applicant was required to providedocumentation under IC 3-7-33-4.5; and
(2) if so, whether the required documentation has beenprovided.
(b) If the documentation required under IC 3-7-33-4.5 has beenprovided, the entry must include the following:
(1) The date the documentation was filed with the county voterregistration office.
(2) Whether the documentation was filed with the county voterregistration office by:
(A) a precinct election board after the person voted in personat the polling place;
(B) the county election board after the person applied to castan absentee ballot; or
(C) the applicant as part of the original filing of theapplication to register to vote, or in a subsequent filingreceived by the county voter registration office.
(3) A brief description of the type of documentation provided.
The election division shall provide each county voter registrationoffice with a suggested coding system for identifying the types ofdocumentation.

Duplicate paper copies of registration information not required
Sec. 21.1. (a) The county voter registration office is not requiredto maintain duplicate paper copies of original registrations.
(b) Notwithstanding IC 5-15, a county voter registration officemay dispose of duplicate paper copies of original registrations madebefore January 1, 2006, by destroying the duplicate paper copies.

Maintenance of registration affidavits
Sec. 22. The county voter registration office may maintain theoriginal affidavits of registration in a secure location outside thecounty voter registration office.
