    Chapter 43. Removal From Registration Records Due to Requestof Voter

Removal of name
    Sec. 1. As provided by 42 U.S.C. 1973gg-6(a)(3)(A), a circuitcourt clerk or board of registration may remove the name of a voterfrom the official list of registered voters at the voter's request.

    Sec. 2. A request from a voter under this chapter must be inwriting and may be on a form prescribed by the commission or otherforms provided by the circuit court clerk or board of registration(including jury notices) if the voter signs the request for removal.

Time for request; cancellation of previous registrations;forwarding notices to appropriate county voter registration office
    Sec. 3. (a) A request from a voter under this chapter may be madewhen the voter registers in another county in Indiana or in ajurisdiction outside of Indiana. A registration form under this sectionmust be signed by the voter or, if not signed by the voter, after theNVRA official notifies the county voter registration office that thejurisdiction where the voter has registered has provided the electiondivision with written notice of the voter's registration in thejurisdiction and request for cancellation of previous registrations.
    (b) The election division shall forward a copy of the notice to theappropriate county voter registration office.

Cancellation of registration; move to another county
    Sec. 4. (a) This section applies only to a person who has:
        (1) moved from the county where the person is registered toanother county in Indiana; and
        (2) executed an affidavit under IC 3-10-11.
    (b) Execution by a person of the affidavit constitutes authorizationby the person to cancel the person's registration in the county of theperson's former residence.
    (c) The circuit court clerk or the board of registration of thecounty of the person's former residence shall mail the originalaffidavit of registration and the affidavit executed under IC 3-10-11within thirty (30) days after the beginning of the next registrationperiod to the clerk or board in the county in which the personcurrently resides, as shown by the affidavit.    (d) Upon receiving the affidavits sent under subsection (c), theclerk or board of the county in which the person currently residesshall transfer the person's registration to the proper precinctregistration record in the county.
    (e) Upon mailing the person's affidavits to another county underthis section, the person's registration in the county of the person'sformer residence shall be canceled.

Cancellation of registration; move to another state
    Sec. 5. (a) This section applies only to a person who has:
        (1) moved from Indiana to another state; and
        (2) executed an affidavit under IC 3-10-10.
    (b) Execution by a person of the affidavit under IC 3-10-10constitutes authorization by the person to cancel the person'sregistration in the county of the person's former residence.

Cancellation of registration at voter's request; time to processrequest
    Sec. 6. (a) This section applies to a voter who requests acancellation of voter registration under IC 3-7-39-6.
    (b) The county voter registration office of the county in which avoter registers shall send the authorization of cancellation to thecounty voter registration office on an expedited basis, as required byIC 3-7-26.3.

Removal and cancellation of affidavit
    Sec. 7. The county voter registration office shall cancel theaffidavit of registration and enter the date and other informationconcerning the cancellation in the computerized list underIC 3-7-26.3.

Cancellation to be sent to proper jurisdiction if registrationcontains out-of-state address
    Sec. 8. (a) If either of the addresses given by a person underIC 3-7-39 is outside Indiana, the county voter registration office shallsend the authorization of cancellation to the election division on anexpedited basis.
