    Chapter 20. Release of Medical History Information

Release of medical history; supplementation
    
Sec. 1. The state registrar:
        (1) shall release a copy of the medical history to any interestedperson;
        (2) may release a copy of the medical history to any person whosatisfies the registrar that the person has a legitimate need; and
        (3) shall supplement the medical history with medicalinformation received from any person.

Request for additional medical history information
    
Sec. 2. (a) Whenever the state registrar receives an inquiry formedical history information from an adoptee or adoptive parent andthe state registrar reasonably believes that the medical historyinformation available under section 1 of this chapter is incomplete,the state registrar shall request further medical history informationconcerning the adoptee from:
        (1) the hospital where the adoptee was born; and
        (2) the:
            (A) licensed child placing agency;
            (B) county office of family and children; and
            (C) attorney;
        that arranged the adoptee's adoptive placement.
    (b) A hospital, a licensed child placing agency, a county office offamily and children, or an attorney that receives a request for medicalinformation under subsection (a) shall release medical historyinformation concerning the adoptee to the state registrar.
    (c) The state registrar shall release any additional medical historyinformation received under subsection (b) to the adoptee or adoptiveparent.

Fees; disposition
    
Sec. 3. (a) The state department of health may charge a reasonablefee for the state registrar's search for further medical historyinformation under section 2(a) of this chapter or death certificates.
    (b) Fees collected under this section shall be deposited in theadoption history fund established by IC 31-19-18-6 and must be usedfor the automation of adoption history information and deathcertificates and for improved service delivery.

IC 31-19-20-4 Release of medical records by provider
    
Sec. 4. IC 31-19-19, this chapter, and IC 31-19-21 throughIC 31-19-24 do not restrict a provider (as defined in IC 16-18-2-295)from releasing medical records to an attorney or agency arranging anadoption if the provider receives the appropriate authorization underIC 16-39-1.
