Chapter 5.7. Older Youth Foster Care

Eligible persons; petitions; reasons petitions are granted;termination
Sec. 1. (a) An individual who:
(1) is at least eighteen (18) but less than twenty-one (21) yearsof age; and
(2) received foster care under a court order during the monthbefore the individual became eighteen (18) years of age;
is eligible to receive foster care services at any time until theindividual becomes twenty-one (21) years of age.
(b) An individual described in subsection (a) may request thedepartment to petition a court for the individual to receive olderyouth foster care services.
(c) A court shall grant a petition described in subsection (b) if theindividual is:
(1) employed;
(2) attending a vocational or educational certification or degreeprogram; or
(3) planning on attending a vocational or educationalcertification or degree program within six (6) months of theindividual's eighteenth birthday.
(d) An individual may request the department to start the petitionprocess described in subsections (b) and (c) for the individual if theindividual is at least seventeen (17) years and six (6) months of age.
(e) If an older youth receiving foster care:
(1) is receiving foster care because the older youth planned onattending a vocational or educational certification program; and
(2) does not begin attending a vocational or educationalcertification program within nine (9) months after theindividual's eighteenth birthday;
foster care for the individual ceases without further action of thecourt.

Adoption of rules
Sec. 2. The department shall adopt rules under IC 4-22-2 toimplement this chapter. The rules adopted under this section mustapply to individuals working or attending vocational or educationalprograms as set forth in section 1 of this chapter.
