    Chapter 16. Petition for Parental Participation

Standing
    
Sec. 1. Any of the following may sign and file a petition for thejuvenile court to require the participation of a parent, guardian, orcustodian in a program of care, treatment, or rehabilitation for achild:
        (1) The attorney for the department.
        (2) The guardian ad litem or court appointed special advocate.

Sec. 2. A petition filed under section 1 of this chapter must beverified.

Caption; allegations
    
Sec. 3. A petition seeking participation of a parent, guardian, orcustodian must be entitled "In the Matter of the Participation of_________ the Parent, Guardian, or Custodian of _________". Thepetition must allege the following:
        (1) That the respondent is the child's parent, guardian, orcustodian.
        (2) That the child has been adjudicated a child in need ofservices.
        (3) That the parent, guardian, or custodian should:
            (A) obtain assistance in fulfilling obligations as a parent,guardian, or custodian;
            (B) provide specified care, treatment, or supervision for thechild;
            (C) work with a person providing care, treatment, orrehabilitation for the child; or
            (D) refrain from direct or indirect contact with the child.

Hearing; advisement to parent; decree
    
Sec. 4. (a) The court may hold a hearing on a petition concurrentlywith a dispositional hearing or with a hearing to modify adispositional decree.
    (b) If the order concerns participation of a parent, the juvenilecourt shall advise the parent that failure to participate as required byan order issued under IC 31-34-20-3 (or IC 31-6-4-15.8 before itsrepeal) can lead to the termination of the parent-child relationshipunder IC 31-35.    (c) If the court finds that the allegations under section 3 of thischapter are true, the court shall enter a decree.
