Chapter 14. Warehouseman's Lien

Property and services subject to lien
Sec. 1. (a) All persons, firms, limited liability companies, andcorporations engaged in the business of storing, warehousing, andforwarding goods, wares, and merchandise have a lien upon allgoods, wares, and merchandise left with them for storage,warehousing, or forwarding, to the extent of the:
(1) value of the services of storage, warehousing, or forwarding;
(2) fair and reasonable charges for transporting the goods,wares, and merchandise to the place of storage, warehousing, orforwarding; and
(3) fair and reasonable charges for packing, crating, andotherwise placing the goods, wares, and merchandise incondition to be stored, warehoused, or forwarded.
(b) However, the goods subject to a lien under this section mustremain in the possession of the person, firm, limited liabilitycompany, or corporation engaged in the business.

Sale of property; notice
Sec. 2. (a) If goods, wares, or merchandise have remained in thepossession of a person, firm, limited liability company, orcorporation described in section 1 of this chapter for a period of atleast six (6) months without the payment of the charges due, thegoods, wares, or merchandise, or as much of the goods, wares, ormerchandise as is necessary, may be sold at public auction to pay theamount of the lien and the expenses of the sale.
(b) Before a sale under subsection (a), the person, firm, limitedliability company, or corporation described in section 1 of thischapter must give public notice of the time and place of the sale byadvertisements set up for a period of ten (10) days in three (3) publicplaces in the city or township in which the goods, wares, ormerchandise are located. One (1) of the advertisements must be:
(1) displayed in a conspicuous part of the place of business ofthe person, firm, limited liability company, or corporation; or
(2) if the value of the article or articles is at least ten dollars($10), published for three (3) weeks successively in anewspaper published in the county or city in which the goodsare located.
(c) The notice given under subsection (b) must:
(1) state the time, place, and date of sale;
(2) give a general description of the goods to be sold; and
(3) state the name of the person to whom a receipt for the goodswas issued.

Proceeds of sale; disposition
Sec. 3. The proceeds of a sale under section 2 of this chapter, afterpayment of all lien charges, together with the expenses of notice andsale, shall, if the owner is absent from the sale, be deposited with thecounty treasurer of the county in which the sale occurred. A receiptshall be issued for the proceeds. The proceeds are subject to theorder of the person legally entitled to the proceeds.
