Chapter 3. Duties and Powers

Court rules; adoption and publication
Sec. 1. The supreme court shall adopt and publish rules inconformity with IC 33-24-1-2(b) specifying the terms and conditionsunder which the supreme court and the court of appeals exercisejurisdiction.

Publication and distribution of opinions and reports
Sec. 2. The judicial opinion or decision in each case determinedby the supreme court shall be reduced to writing. Reports of theseopinions and decisions may be published and distributed in themanner prescribed by the supreme court.

Seal
Sec. 3. (a) The supreme court shall have a seal that is devised bythe justices of the supreme court.
(b) A description of the seal shall be recorded in the office of thesecretary of state.

Powers of court
Sec. 4. The supreme court may do the following:
(1) Frame, direct, and cause to be used all process, establishmodes of practice that may be necessary in the exercise of thesupreme court's authority, and make and publish regulationsconcerning all process and modes of practice.
(2) Establish regulations concerning bonds required in appealsto the supreme court, the amount of the penalties related to thebonds, and for approving sureties executing bonds.
(3) Establish regulations concerning giving notice to officers ofinferior courts of the granting of stay of execution, or ofsupersedeas.
(4) Establish regulations concerning proceedings that arerequisite in the supreme court in the exercise of the supremecourt's authority that are not specially provided for by law.

Additional powers of court
Sec. 5. The supreme court may:
(1) impose and administer all necessary oaths;
(2) punish by fine and imprisonment for contempt of the
supreme court's authority; and
(3) process and compel the attendance of witnesses byattachment and fine.

Certification of questions to court by federal appellate courts
Sec. 6. The supreme court may, by rule of court, provide that if:
(1) the Supreme Court of the United States, a circuit court ofappeals of the United States, or the court of appeals of theDistrict of Columbia determines that there are involved in anyproceeding before the federal appellate court questions orpropositions of the laws of Indiana that are determinative of theproceeding; and
(2) there are no clear controlling precedents in the decisions ofthe supreme court;
the federal appellate court may certify the questions or propositionsof the laws of Indiana to the supreme court for instructionsconcerning the questions or propositions of state law, and thesupreme court, by written opinion, may answer.

Senior judge; appointment; rules
Sec. 7. (a) The supreme court may appoint a judge who is certifiedas a senior judge by the judicial nominating commission to serve acircuit court, a superior court, a county court, a probate court, the taxcourt, or the court of appeals if the court requests the services of asenior judge.
(b) The supreme court may adopt rules concerning:
(1) certification by the judicial nominating commission; and
(2) appointment by the supreme court;
of senior judges.
