    Chapter 22. Floyd County

IC 33-33-22-1
Judicial circuit; magistrate
    
Sec. 1. (a) Floyd County constitutes the fifty-second judicialcircuit.
    (b) The judges of the Floyd circuit court and Floyd superior courtsmay jointly appoint one (1) full-time magistrate under IC 33-23-5 toserve the circuit and superior courts.
    (c) The magistrate continues in office until removed by the judgesof the Floyd circuit and superior courts.

Establishment of standard superior courts
    
Sec. 2. (a) There are established three (3) courts of record to beknown as the Floyd superior court No. 1, Floyd superior court No. 2,and Floyd superior court No. 3.
    (b) Except as provided in section 3 of this chapter, each Floydsuperior court is a standard superior court as described in IC 33-29-1.
    (c) Floyd County comprises the judicial district of each court.

Judges; election
    
Sec. 3. (a) IC 33-29-1-3 does not apply to this section.
    (b) Each Floyd superior court has one (1) judge, who shall beelected at the general election every six (6) years in Floyd County.A judge's term begins January 1 following the judge's election andends December 31 following the election of the judge's successor.

Location of court sessions
    
Sec. 4. Each Floyd superior court shall hold its sessions in:
        (1) the Floyd County courthouse in New Albany; or
        (2) other places in the county as the board of countycommissioners of Floyd County may provide.

Jurisdiction
    
Sec. 5. Each Floyd superior court has the same jurisdiction as theFloyd circuit court, except that only:
        (1) the circuit court has jurisdiction over probate and trustmatters; and
        (2) the circuit court and Floyd superior court No. 3 have

concurrent juvenile jurisdiction.

Small claims and misdemeanor division
    
Sec. 7. Each Floyd superior court has a standard small claims andmisdemeanor division.
