Establishment; seal; judicial district
Sec. 2. (a) There is established a court of record to be known asthe Grant superior court No. 3 (referred to as "the court" in thischapter).
(b) The court may have a seal containing the words "GrantSuperior Court No. 3, Grant County, Indiana".
(c) Grant County comprises the judicial district of the court.

Judge; election; term; qualifications
Sec. 3. (a) The court has one (1) judge who shall be elected at thegeneral election every six (6) years in Grant County. The judge'sterm begins January 1 following the election and ends December 31following the election of the judge's successor.
(b) To be eligible to hold office as a judge of the court, a personmust be:
(1) a resident of Grant County;
(2) less than seventy (70) years of age at the time of takingoffice; and
(3) admitted to the practice of law in Indiana.

Jurisdiction
Sec. 4. The court has the same jurisdiction as the Grant circuitcourt.

Judicial powers
Sec. 5. The judge of the court:
(1) has the same powers relating to the conduct of the businessof the court as the judges of the Grant circuit court, Grantsuperior court, and Grant superior court No. 2; and
(2) may administer oaths, solemnize marriages, and take andcertify acknowledgments of deeds.

Bailiff and court reporter Sec. 6. (a) The judge of the court shall appoint a bailiff and anofficial court reporter for the court.
(b) The salaries of the bailiff and the official court reporter shallbe:
(1) fixed in the same manner as the salaries of the bailiff andofficial court reporter for the Grant circuit court, Grant superiorcourt, and Grant superior court No. 2; and
(2) paid monthly out of the treasury of Grant County asprovided by law.

Books and dockets of court
Sec. 7. The clerk of the court, under the direction of the judge ofthe court, shall provide:
(1) order books;
(2) judgment dockets;
(3) execution dockets;
(4) fee books; and
(5) other books for the court;
that shall be kept separately from the books and papers of othercourts.

Location of court sessions
Sec. 8. (a) The court shall hold its sessions in:
(1) the Grant County courthouse in Marion; or
(2) other places in the county that the Grant County executiveprovides.
(b) The Grant County executive shall provide and maintain asuitable courtroom and other rooms and facilities, including furnitureand equipment, as may be necessary.
(c) The Grant County fiscal body shall appropriate sufficientfunds for the provision and maintenance of the rooms and facilities.

Transfer of actions and proceedings
Sec. 10. (a) The judge of the Grant circuit court, Grant superiorcourt, or Grant superior court No. 2 may, with the consent of thejudge of the court, transfer any action or proceeding from the Grantcircuit court, Grant superior court, or Grant superior court No. 2 tothe court.
(b) The judge of the court may, with the consent of the judge ofthe Grant circuit court, Grant superior court, or Grant superior court
No. 2, transfer any action or proceeding from the court to the Grantcircuit court, Grant superior court, or Grant superior court No. 2.

Sitting of judges
Sec. 11. (a) The judge of the Grant circuit court, Grant superiorcourt, or Grant superior court No. 2 may, with the consent of thejudge of the court, sit as judge of the court in any matter as if anelected judge of the court.
(b) The judge of the court may, with the consent of the judge ofthe Grant circuit court, Grant superior court, or Grant superior courtNo. 2, sit as a judge of the Grant circuit court, Grant superior court,or Grant superior court No. 2 in any matter as if an elected judge ofthe Grant circuit court, Grant superior court, or Grant superior courtNo. 2.

Small claims and misdemeanor division
Sec. 12. (a) The court has a standard small claims andmisdemeanor division.
(b) Notwithstanding IC 33-29-2-4, the small claims docket hasjurisdiction over the following:
(1) Civil actions in which the amount sought or value of theproperty sought to be recovered is not more than six thousanddollars ($6,000). The plaintiff in a statement of claim or thedefendant in a counterclaim may waive the excess of any claimthat exceeds six thousand dollars ($6,000) in order to bring theclaim within the jurisdiction of the small claims docket.
(2) Possessory actions between landlord and tenant in which therent due at the time the action is filed does not exceed sixthousand dollars ($6,000).
(3) Emergency possessory actions between a landlord andtenant under IC 32-31-6.
