    Chapter 4. Injunction Against Distribution of Tobacco to PersonsLess Than 18 Years of Age

Violation of IC 35-46-1-10; application for injunction
    Sec. 1. If a violation of IC 35-46-1-10 is being committed, anyperson may apply for an order enjoining the violation from the circuitcourt or a superior court of the county in which the violation occurs.

Issuance of injunction or order; costs and attorney's fees; waiverof bond
    Sec. 2. (a) Upon a showing that a person has violatedIC 35-46-1-10, the court may grant:
        (1) an injunction, restraining order, or other appropriate order;and
        (2) the costs and reasonable attorney's fees of the personbringing the action.
    (b) The court may grant an order under subsection (a) withoutrequiring the person bringing the action to post a bond.
