Chapter 6. Environment: Immunity from Liability for CertainHazardous Discharges

Acts or omissions; immunity
Sec. 1. Except as provided in section 2 of this chapter, a person isnot liable for any loss that results from an action taken or lack of anaction by that person:
(1) during an emergency; and
(2) with intent to prevent or minimize harm from theemergency.

Acts or omissions; liability
Sec. 2. This chapter does not apply to a person:
(1) whose act or omission caused in whole or in part theemergency and who would otherwise be liable for theemergency;
(2) whose act or omission constituted gross negligence orwillful or wanton misconduct; or
(3) who receives payment, or is an employee of a person whoreceives payment, for services rendered in connection with theemergency, from a person whose act or omission caused inwhole or in part the emergency. Payment does not includereimbursement for expenses.
