Chapter 11. Victim's Discretion; Form of Statement

Victim's right to be heard at court proceedings
Sec. 1. It is at the victim's discretion to exercise the victim's rightsunder this article to be present and to be heard at court proceedings,and the absence of the victim at a court proceeding does not precludethe court from holding the proceeding.

Oral, written, or taped statements allowed
Sec. 2. Except as provided in section 3 of this chapter, a victim'sright to be heard may be exercised, at the victim's discretion, throughan oral statement, submission of a written statement, or submissionof a statement through audiotape or videotape.

Statement when victim in custody
Sec. 3. If a victim is in custody for committing or allegedlycommitting an offense, the victim may be heard by submitting awritten statement to the court.
