    Chapter 4. Failure of a Student Athlete to Disclose Recruitment

"Agent contract"
    
Sec. 1. As used in this chapter, "agent contract" means a contractor agreement in which a student athlete authorizes a person tonegotiate or solicit on behalf of the student athlete:
        (1) an agreement with a professional sports team for:
            (A) the employment of the student athlete by a professionalsports team or organization; or
            (B) the employment of the student athlete as a professionalathlete; or
        (2) an endorsement contract.

"Endorsement contract"
    
Sec. 1.5. As used in this chapter, "endorsement contract" meansan agreement under which a student athlete is employed or receivesconsideration to use, on behalf of the other party, any value that thestudent athlete may have because of publicity, reputation, following,or fame obtained because of athletic ability or performance. The termincludes the value of any part of the student athlete's right ofpublicity (as defined in IC 32-36-1-7).

"Professional sports services contract"
    
Sec. 2. As used in this chapter, "professional sports servicescontract" means a contract or agreement in which a person isemployed or agrees to render services:
        (1) as a player on a professional sports team;
        (2) as a professional athlete; or
        (3) with a professional sports organization.

"Student athlete"
    
Sec. 3. As used in this chapter, "student athlete" means a personwho is:
        (1) enrolled or intends to enroll in a course of study in a publicor private college or university; and
        (2) eligible to engage in, or may be eligible in the future toengage in, an intercollegiate sporting event, contest, exhibition,or program for the college or university in which the person isenrolled or intends to enroll.

Failure to disclose recruitment
    
Sec. 4. A person who knowingly or intentionally:
        (1) enters into an agent contract, an endorsement contract, or aprofessional sports services contract with a student athlete; and
        (2) no later than ten (10) days before the contract is executed,fails to give written notice to the head of the athletic departmentfor the college or university in which the student athlete isenrolled as a student or intends to enroll as a student thatidentifies:
            (A) the name and business address of each party to thecontract;
            (B) whether the contract is an agent contract, anendorsement contract, or a professional sports servicescontract; and
            (C) the date that the contract will be executed;
commits failure to disclose recruitment, a Class D felony.
