Chapter 1. Applicability

Application

    

Sec. 1. This article does not apply to the following:

        (1) Fertilizers, propellant actuated devices, or propellant
activated industrial tools:

            (A) manufactured;

            (B) imported;

            (C) distributed; or

            (D) used;

        for their designed purposes.

        (2) A pesticide that is:

            (A) manufactured;

            (B) stored;

            (C) transported;

            (D) distributed;

            (E) possessed; or

            (F) used;

        for its designed purposes or in accordance with Chapter 7 of
Title 2, the federal Insecticide, Fungicide, and Rodenticide Act,
61 Stat. 163, as amended, and the federal Environmental
Pesticide Control Act of 1972, P.L.92-516, as amended.
