    Chapter 14.2. Insurance for Charitable Health Care Services

Authorization to disburse funds; use; liability
    
Sec. 1. A state or local governmental unit is authorized to disbursefunds to a medical clinic or health care facility that provides healthcare to individuals without compensation. Funding obtained underthis section must be used by the clinic or facility to purchaseprofessional liability insurance to provide the clinic or facility with:
        (1) medical malpractice protection; and
        (2) compensation for required surcharges;
under IC 34-18. However, the disbursement of funds by a state orlocal governmental unit does not create any liability for that unit asa result of any acts or omissions of the medical clinic or health carefacility that receives the funds.

Purchase of professional liability insurance
    
Sec. 2. Whenever a medical clinic or health care facility purchasesprofessional liability insurance under section 1 of this chapter, theclinic or facility must purchase the insurance directly from aninsurance company.

Immunity from civil liability
    
Sec. 3. A person who provides health care to an individual at amedical clinic or health care facility described in this chapter isimmune from civil liability to the extent described in IC 34-30-13.
