Chapter 14. Public Playgrounds Maintained by School; ThirdClass Cities

Application
Sec. 1. This chapter applies only to a school corporation in a thirdclass city with a board of school trustees.

"Board"
Sec. 2. As used in this chapter, "board" refers to a board of schooltrustees in a third class city.

Power; public playground
Sec. 3. The board may establish, maintain, and equip publicplaygrounds to be used by children during the summer vacationperiod. The board may use the public school buildings and groundsin the cities as is necessary to carry out this chapter.

Power; levy
Sec. 4. Subject to IC 6-1.1-18-12, the board may levy a tax notexceeding sixty-seven hundredths of one cent ($0.0067) on each onehundred dollars ($100) of assessed valuation of the property in thecity to create a fund to carry out this chapter.

Lease or purchase of nonschool property
Sec. 5. The board may lease or purchase grounds in addition to theschool grounds, either adjacent to the school grounds or elsewherein the city. The board may also, under eminent domain statutes,condemn ground to be used for these purposes and pay forcondemned ground out of the school revenues of the city nototherwise appropriated.

Management of property
Sec. 6. The board:
(1) has full control of all playgrounds, including thepreservation of order on playgrounds; and
(2) may adopt suitable rules and bylaws for the control ofplaygrounds. The board may enforce the rules by suitablepenalties.As added by P.L.2-2006, SEC.197.

Personnel
Sec. 7. (a) The board may select and pay for directors andassistants.
(b) The directors and assistants, while on duty and to preserveorder and the observance of the rules and bylaws of the board, haveall the powers of police officers of the city.
(c) The compensation for the directors and assistants shall be:
(1) fixed by the board; and
(2) paid from school revenues not otherwise appropriated.
