"County office"; general assembly findings
Sec. 1. (a) As used in this section, "county office" has themeaning set forth in IC 36-1-8-15.
(b) The general assembly finds the following:
(1) That due to events that occurred at different times inIndiana's history, the beginning of the terms of certain electedcounty offices varies from a uniform date due to changes in thedates of general elections, vacancies in offices, and other eventsdescribed by the Indiana supreme court in the following cases:
(A) Howard v. State, 10 Ind. 74 (Ind. 1857).
(B) Greible v. State, 12 N.E. 700 (Ind. 1887).
(C) State v. Menaugh, 51 N.E. 117 (Ind. 1898).
(D) Scott v. State, 52 N.E. 163 (Ind. 1898).
(2) That on many occasions at the beginning of the twentiethcentury, the general assembly attempted to standardize thebeginning of the terms of county offices.
(3) That the voters of Indiana approved an amendment toArticle 6, Section 2 of the Constitution of the State of Indianaat the November 2004 general election authorizing the generalassembly to provide by law for uniform dates for beginning theterms of county offices.
(4) That the variation in the beginning dates of the terms ofcounty offices is not a general condition but affects only aknown and fixed set of county offices.
(5) That a statement of a rule applicable to each county officewhose term varies from a uniform date would be clearer inapplication than a general statement of a rule to make thebeginning of the terms of those county offices uniform.
(c) The general assembly enacts this chapter to:
(1) provide a rule applicable to each county office whose termof office deviates from a uniform date as of June 30, 2005; and
(2) implement Article 6, Section 2(b) of the Constitution of theState of Indiana to provide for a uniform date for beginning theterms of county offices described in Article 6, Section 2(a) ofthe Constitution of the State of Indiana.

Adams County circuit court clerk
Sec. 2. (a) As used in this section, "clerk" refers to the clerk of thecircuit court of Adams County.
(b) Notwithstanding any other law concerning terms of office, thefollowing apply:
(1) The individual elected to the office of clerk at the November2002 general election is entitled to serve in the office until
January 1, 2008.
(2) The individual elected to the office of clerk at the November2006 general election is entitled to:
(A) take office on January 1, 2008, if the individualqualifies; and
(B) serve in the office until January 1, 2011.
(3) The individual elected to the office of clerk at the November2010 general election is entitled to:
(A) take office on January 1, 2011, if the individualqualifies; and
(B) serve in the office until January 1, 2015.

Adams County treasurer
Sec. 3. (a) As used in this section, "treasurer" refers to thetreasurer of Adams County.
(b) Notwithstanding any other law concerning terms of office, thefollowing apply:
(1) The individual elected to the office of treasurer at theNovember 2004 general election is entitled to serve in the officeuntil January 1, 2010.
(2) The individual elected to the office of treasurer at theNovember 2008 general election is entitled to:
(A) take office on January 1, 2010, if the individualqualifies; and
(B) serve in the office until January 1, 2013.
(3) The individual elected to the office of treasurer at theNovember 2012 general election is entitled to:
(A) take office on January 1, 2013, if the individualqualifies; and
(B) serve in the office until January 1, 2017.

Bartholomew County circuit court clerk
Sec. 4. (a) As used in this section, "clerk" refers to the clerk of thecircuit court of Bartholomew County.
(b) Notwithstanding any other law concerning terms of office, thefollowing apply:
(1) The individual elected to the office of clerk at the November2002 general election is entitled to serve in the office untilJanuary 1, 2008.
(2) The individual elected to the office of clerk at the November2006 general election is entitled to:
(A) take office on January 1, 2008, if the individualqualifies; and
(B) serve in the office until January 1, 2011.
(3) The individual elected to the office of clerk at the November2010 general election is entitled to: (A) take office on January 1, 2011, if the individualqualifies; and
(B) serve in the office until January 1, 2015.

Sec. 5. (a) As used in this section, "clerk" refers to the clerk of thecircuit court of Blackford County.
(b) Notwithstanding any other law concerning terms of office, thefollowing apply:
(1) The individual elected to the office of clerk at the November2004 general election is entitled to serve in the office untilJanuary 1, 2010.
(2) The individual elected to the office of clerk at the November2008 general election is entitled to:
(A) take office January 1, 2010, if the individual qualifies;and
(B) serve in the office until January 1, 2013.
(3) The individual elected to the office of clerk at the November2012 general election is entitled to:
(A) take office January 1, 2013, if the individual qualifies;and
(B) serve in the office until January 1, 2017.

Sec. 6. (a) As used in this section, "recorder" refers to the recorderof Blackford County.
(b) Notwithstanding any other law concerning terms of office, thefollowing apply:
(1) The individual elected to the office of recorder at theNovember 2004 general election is entitled to serve in the officeuntil January 1, 2010.
(2) The individual elected to the office of recorder at theNovember 2008 general election is entitled to:
(A) take office January 1, 2010, if the individual qualifies;and
(B) serve in the office until January 1, 2013.
(3) The individual elected to the office of recorder at theNovember 2012 general election is entitled to:
(A) take office January 1, 2013, if the individual qualifies;and
(B) serve in the office until January 1, 2017.

Sec. 7. (a) As used in this section, "clerk" refers to the clerk of the
circuit court of Brown County.
(b) Notwithstanding any other law concerning terms of office, thefollowing apply:
(1) The individual elected to the office of clerk at the November2002 general election is entitled to serve in the office untilJanuary 1, 2008.
(2) The individual elected to the office of clerk at the November2006 general election is entitled to:
(A) take office January 1, 2008, if the individual qualifies;and
(B) serve in the office until January 1, 2011.
(3) The individual elected to the office of clerk at the November2010 general election is entitled to:
(A) take office January 1, 2011, if the individual qualifies;and
(B) serve in the office until January 1, 2015.

(2) The individual elected to the office of recorder at theNovember 2006 general election is entitled to:
(A) take office January 1, 2008, if the individual qualifies;and
(B) serve in the office until January 1, 2011.
(3) The individual elected to the office of recorder at theNovember 2010 general election is entitled to:
(A) take office January 1, 2011, if the individual qualifies;and
(B) serve in the office until January 1, 2015.

Sec. 9. (a) As used in this section, "auditor" refers to the auditorof Clark County.
(b) Notwithstanding any other law concerning terms of office, thefollowing apply:
(1) The individual elected to the office of auditor at theNovember 2002 general election is entitled to serve in the officeuntil January 1, 2008.
(2) The individual elected to the office of auditor at theNovember 2006 general election is entitled to: (A) take office January 1, 2008, if the individual qualifies;and
(B) serve in the office until January 1, 2011.
(3) The individual elected to the office of auditor at theNovember 2010 general election is entitled to:
(A) take office January 1, 2011, if the individual qualifies;and
(B) serve in the office until January 1, 2015.

Sec. 10. (a) As used in this section, "clerk" refers to the clerk ofthe circuit court of Clark County.
(b) Notwithstanding any other law concerning terms of office, thefollowing apply:
(1) The individual elected to the office of clerk at the November2002 general election is entitled to serve in the office untilJanuary 1, 2008.
(2) The individual elected to the office of clerk at the November2006 general election is entitled to:
(A) take office January 1, 2008, if the individual qualifies;and
(B) serve in the office until January 1, 2011.
(3) The individual elected to the office of clerk at the November2010 general election is entitled to:
(A) take office January 1, 2011, if the individual qualifies;and
(B) serve in the office until January 1, 2015.

(2) The individual elected to the office of treasurer at theNovember 2006 general election is entitled to:
(A) take office January 1, 2008, if the individual qualifies;and
(B) serve in the office until January 1, 2011.
(3) The individual elected to the office of treasurer at theNovember 2010 general election is entitled to:
(A) take office January 1, 2011, if the individual qualifies;and

Sec. 12. (a) As used in this section, "clerk" refers to the clerk ofthe circuit court of Clinton County.
(b) Notwithstanding any other law concerning terms of office, thefollowing apply:
(1) The individual elected to the office of clerk at the November2002 general election is entitled to serve in the office untilJanuary 1, 2008.
(2) The individual elected to the office of clerk at the November2006 general election is entitled to:
(A) take office January 1, 2008, if the individual qualifies;and
(B) serve in the office until January 1, 2011.
(3) The individual elected to the office of clerk at the November2010 general election is entitled to:
(A) take office January 1, 2011, if the individual qualifies;and
(B) serve in the office until January 1, 2015.

(2) The individual elected to the office of recorder at theNovember 2008 general election is entitled to:
(A) take office January 1, 2010, if the individual qualifies;and
(B) serve in the office until January 1, 2013.
(3) The individual elected to the office of recorder at theNovember 2012 general election is entitled to:
(A) take office January 1, 2013, if the individual qualifies;and
(B) serve in the office until January 1, 2017.

Sec. 14. (a) As used in this section, "clerk" refers to the clerk ofthe circuit court of Daviess County.
(b) Notwithstanding any other law concerning terms of office, thefollowing apply: (1) The individual elected to the office of clerk at the November2002 general election is entitled to serve in the office untilMarch 13, 2008.
(2) The individual elected to the office of clerk at the November2006 general election is entitled to:
(A) take office March 13, 2008, if the individual qualifies;and
(B) serve in the office until January 1, 2011.
(3) The individual elected to the office of clerk at the November2010 general election is entitled to:
(A) take office January 1, 2011, if the individual qualifies;and
(B) serve in the office until January 1, 2015.

Sec. 15. (a) As used in this section, "coroner" refers to the coronerof Daviess County.
(b) Notwithstanding any other law concerning terms of office, thefollowing apply:
(1) The individual elected to the office of coroner at theNovember 2004 general election is entitled to serve in the officeuntil January 1, 2010.
(2) The individual elected to the office of coroner at theNovember 2008 general election is entitled to:
(A) take office January 1, 2010, if the individual qualifies;and
(B) serve in the office until January 1, 2013.
(3) The individual elected to the office of coroner at theNovember 2012 general election is entitled to:
(A) take office January 1, 2013, if the individual qualifies;and
(B) serve in the office until January 1, 2017.

(2) The individual elected to the office of clerk at the November2006 general election is entitled to:
(A) take office February 14, 2008, if the individual qualifies;and
(B) serve in the office until January 1, 2011.
(3) The individual elected to the office of clerk at the November2010 general election is entitled to:
(A) take office January 1, 2011, if the individual qualifies;and

Sec. 32. (a) As used in this section, "clerk" refers to the clerk ofthe circuit court of Jackson County.
(b) Notwithstanding any other law concerning terms of office, thefollowing apply:
(1) The individual elected to the office of clerk at the November2002 general election is entitled to serve in the office untilFebruary 25, 2008.
(2) The individual elected to the office of clerk at the November2006 general election is entitled to:
(A) take office February 25, 2008, if the individual qualifies;and
