Chapter 19.5. Public Safety Improvement Areas

Applicability of chapter
Sec. 1. This chapter applies to consolidated and second classcities.

"Institute" defined
Sec. 2. As used in this chapter, "institute" means the Indianacriminal justice institute established under IC 5-2-6-3.

Designation of public safety improvement areas
Sec. 3. (a) A legislative body may apply to the institute to have anarea of a city governed by the legislative body designated as a publicsafety improvement area. The application must include a plan forimproving public safety within the area.
(b) The institute may not designate an area as a public safetyimprovement area unless the area:
(1) has a high crime rate;
(2) has boundaries that are expressly designated by thelegislative body; and
(3) comprises not more than twenty percent (20%) of the city'sgeographical territory.

Adoption of rules
Sec. 4. The institute shall adopt rules under IC 4-22-2 to carry outthis chapter. The rules must include the following:
(1) A definition of a public safety improvement area.
(2) A description of what constitutes a high crime rate.
(3) Guidelines for the application and approval process fordesignating an area as a public safety improvement area.
(4) A method for:
(A) publishing a description of each public safety areaapproved by the institute; and
(B) informing the residents of a city whenever the institutedesignates an area of the city as a public safety improvementarea.
(5) A procedure for the institute to give priority to public safetyimprovement areas when the institute is involved in:
(A) awarding; or
(B) administering the award of;
grants that public safety improvement areas are eligible toreceive.As added by P.L.21-1994, SEC.3.

Duration and renewal of designation
Sec. 5. (a) The institute may approve an area as a public safetyimprovement area under this chapter for five (5) years.
(b) A legislative body may reapply to have an area designated asa public safety improvement area under the application and approvalprocess described in this chapter.
