    Chapter 12. Parking Meters and Parking Fees

Sec. 1. This chapter applies to all municipalities.

Use of parking meters authorized
    
Sec. 2. A municipality may:
        (1) regulate the parking or standing of vehicles upon or off anypublic way in the municipality; and
        (2) provide for the collection of license fees from a personparking or standing a vehicle upon or off any public way in themunicipality;
by the use of parking meters. Regulations and fees under this sectionmust be established by ordinance.

Purchase or lease of parking meters
    
Sec. 3. A municipality may provide, by ordinance, for thepurchase or lease of parking meters. However, the ordinance mustprovide for the payment of the purchase price or rental fees onlyfrom the license fees collected from the parking meters.

Deposit and disbursement of money collected from parking meters
    
Sec. 4. (a) A municipality must provide, by ordinance, that:
        (1) all license fees collected from parking meters shall bedeposited with the municipal fiscal officer;
        (2) the fees shall be deposited to the credit of the municipalityin a special fund; and
        (3) disbursements from the special fund may be made only onorders of the municipal works board, or board of transportation,and only for the purposes listed in subsection (b).
    (b) Disbursements from the special fund may be made only topay:
        (1) the purchase price, rental fees, and cost of installation of theparking meters;
        (2) the cost of maintenance, operation, and repair of the parkingmeters;
        (3) incidental costs and expenses in the operation of the parkingmeters, including the cost of clerks and bookkeeping;
        (4) the cost of traffic signal devices used in the municipality;
        (5) the cost of repairing and maintaining any of the public ways,curbs, and sidewalks where the parking meters are in use, andall public ways connected with them in the municipality;        (6) the cost of acquiring, by lease or purchase, suitable land foroffstreet parking facilities to be operated or leased by themunicipality;
        (7) the principal and interest on bonds issued to acquire parkingfacilities and devices;
        (8) the cost of improving and maintaining land for parkingpurposes and purchasing, installing, and maintaining parkingmeters on that land; and
        (9) the cost of providing approved school crossing protectivefacilities, including the costs of purchase, maintenance,operation, and repair, and all other incidental costs.

Appropriations; budget estimates
    
Sec. 5. (a) Money deposited in the special fund under section 4 ofthis chapter may be expended only upon a specific appropriationmade for that purpose by the municipal legislative body in the samemanner that it appropriates other public money.
    (b) The municipal works board or board of transportation shallprepare an itemized estimate of the money necessary for theoperation of parking meters for the ensuing year at the regular timeof making and filing budget estimates for other departments of themunicipality. These estimates shall be made and presented to themunicipal legislative body in the same manner as other departmentestimates.
    (c) An appropriation under this section is not subject to review bythe county tax adjustment board or the department of localgovernment finance, and the general statutes regarding appropriationof funds do not affect this chapter.

Warrants for expenditures
    
Sec. 6. Warrants for expenditures under this chapter shall beprepared and processed in the manner provided by statute.

Disposition of surplus funds
    
Sec. 7. At the end of a calendar year, money remaining in themunicipal treasury to the credit of the special fund established undersection 4 of this chapter remains in the fund and does not revert tothe general fund of the municipality, but the municipal legislativebody may, by ordinance, transfer any balance in the special fund tothe general fund.

IC 36-9-12-8 Contracts; procedure for awarding
    
Sec. 8. Contracts for public improvements under this chapter mustbe awarded in the manner prescribed by IC 36-1-12.
