Chapter 3. State Government Relocation; Enemy Attack

Governor's duties; general assembly establishing location
Sec. 1. Whenever, due to any emergency resulting from the effectsof enemy attack, or the anticipated effects of a threatened enemyattack, it becomes imprudent, inexpedient or impossible to conductthe affairs of state government at the normal location of the seatthereof in Indianapolis, Marion County, state of Indiana, thegovernor shall, as often as the exigencies of the situation require, byproclamation, declare an emergency temporary location, or locations,for the seat of government at such place, or places, within or withoutthis state as he may deem advisable under the circumstances, andshall take such action and issue such orders as may be necessary foran orderly transition of the affairs of state government to suchemergency temporary location, or locations. Such emergencytemporary location, or locations, shall remain as the seat ofgovernment until the general assembly shall by law establish a newlocation, or locations, or until the emergency is declared to be endedby the governor and the seat of government is returned to its normallocation.

Validity of official acts performed at temporary emergencylocation
Sec. 2. During such time as the seat of government remains atsuch emergency temporary location, or locations, all official actsnow or hereafter required to be performed at the seat of governmentby any officer, agency, department or authority of this state,including the convening and meeting of the general assembly inregular or special session, shall be as valid and binding whenperformed at such emergency temporary location, or locations, as ifperformed at the normal location of the seat of government.

Conflicting laws
Sec. 3. This chapter shall control and be supreme in the event itshall be employed notwithstanding the provisions of any other lawto the contrary or in conflict with this chapter.
