Chapter 12.1. Indiana Historical Society Building

"Commissioner" defined
Sec. 1. As used in this chapter, "commissioner" refers to thecommissioner of the department.

Sec. 2. As used in this chapter, "department" refers to the Indianadepartment of administration created by IC 4-13-1-2.

"Exterior improvements" defined
Sec. 3. As used in this chapter, "exterior improvements" includesaccess roads, landscaping, lighting, parking facilities, and walkways.

"Society" defined
Sec. 4. As used in this chapter, "society" refers to the Indianahistorical society established under IC 23-6-3.

State land; construction funds
Sec. 5. (a) The society may construct a building to house thesociety's offices, collections, and library on land owned by the state.
(b) Except as provided in section 11 of this chapter, state fundsmay not be used for construction of the building.

Furnishing acceptable site; exterior improvements; lease term
Sec. 6. (a) The department shall provide, at no cost to the society,a site acceptable to the society for the construction of the building bythe society.
(b) The department may, alone, with the Indiana finance authority,the Indiana White River state park development commission, or anyother entity do the following in relation to the construction of thebuilding by the society:
(1) Acquire a site by purchase, lease, or other appropriatemethod.
(2) Provide related exterior improvements for the building.
(c) Notwithstanding the term limitation for a lease underIC 4-20.5-5-7, the department may enter into a lease under subsection(b) for a term of not more than ninety-nine (99) years.As added by P.L.22-1992, SEC.1. Amended by P.L.7-1993, SEC.6;P.L.235-2005, SEC.54.

Conveyance of title to state
Sec. 7. After completion of construction and negotiation of a leaseunder section 8 of this chapter, the society shall convey title to thebuilding to the state.

Lease with society; term; rental; services provided; vacating ofbuilding; state activities or functions
Sec. 8. (a) The department may enter into a lease with the societyfor the society's use of any part of the building, exteriorimprovements, and surrounding site.
(b) Notwithstanding the term limitation for a lease underIC 4-13-1-4(10), the department may enter into a lease undersubsection (a) for a term of not more than ninety-nine (99) years.
(c) Rent under a lease entered into under this section is one dollar($1) each year, payable in advance.
(d) A lease entered into under this section must require thedepartment to provide, at no cost to the society, the followingservices in relation to the building, the exterior improvements, andthe surrounding site:
(1) Management.
(2) Maintenance.
(3) Operation.
(4) Utilities (other than telephone services).
(5) Other services reasonably necessary to maintain thebuilding, exterior improvements, and the surrounding site.
(e) A lease entered into under this section must provide that thelease terminates if the society or its successor vacates the building.
(f) A lease entered into under this section may permit the buildingto house state activities or functions.

State facilities; reversion of occupancy
Sec. 9. Upon completion of the construction authorized by thischapter and the society's occupancy of the building, space currentlyoccupied by the society in other state facilities reverts to the state.

Lease; approval
Sec. 10. A lease entered into under this chapter is subject toapproval under IC 4-13-2-14.1.

Gifts and grants
Sec. 11. (a) The department may receive gifts and grants underterms, obligations, and liabilities that the commissioner considersappropriate.
(b) The commissioner shall use a gift or grant received undersubsection (a):
(1) to carry out this chapter; and
(2) according to the terms of the gift or grant.

Trust fund; creation; administration; investments; reversion togeneral fund
Sec. 12. (a) At the request of the commissioner, the auditor ofstate shall establish a trust fund for purposes of holding moneyreceived under section 11 of this chapter.
(b) A trust fund created under this section shall be administeredby the department.
(c) The expenses of administering the fund shall be paid frommoney in the fund.
(d) The treasurer of state shall invest the money in the fund notcurrently needed to meet the obligations of the fund in the samemanner as other public trust funds may be invested. Interest thataccrues from these investments shall be deposited in the fund.
(e) Money in the fund at the end of a state fiscal year does notrevert to the state general fund.
