    Chapter 17. Internet Purchasing Sites

"Department"
    
Sec. 1. As used in this chapter, "department" refers to the Indianadepartment of administration established by IC 4-13-1-2.

"Internet purchasing site"
    
Sec. 2. As used in this chapter, "Internet purchasing site" meansan open and interactive electronic environment that is:
        (1) designed to facilitate the purchase and sale of suppliesconducted under IC 5-22;
        (2) approved and managed by the department; and
        (3) linked to the computer gateway administered by the officeof technology established by IC 4-13.1-2-1.

"Purchasing agency"
    
Sec. 3. As used in this chapter, "purchasing agency" has themeaning set forth in IC 5-22-2-25.

Internet purchasing site; rules; procedures for operation
    
Sec. 4. The department may adopt rules under IC 4-22-2 toestablish the following:
        (1) Procedures for the use of Internet purchasing sites tofacilitate the purchase of supplies or sales conducted underIC 5-22 by a state agency. The rules may permit use of anInternet purchasing site to facilitate purchases of supplies andsales conducted by any of the following if considered beneficialby the department:
            (A) A purchasing agency other than a state agency.
            (B) A cooperative purchasing organization described inIC 5-22-4-7.
            (C) The public.
        (2) User fees payable by either of the following:
            (A) A bidder using an Internet purchasing site.
            (B) Entities other than state agencies that use the Internetpurchasing site permitted under subdivision (1).
        (3) The technical requirements for operation of an Internetpurchasing site.
        (4) Procedures requiring the proper officers to maintainadequate documentation of transactions performed through theInternet purchasing site so that the officers may be audited asprovided by law.        (5) Procedures necessary for the operation of Internetpurchasing sites.

Internet purchasing site; requirements
    
Sec. 5. An Internet purchasing site must do all the following:
        (1) Provide an authorized user with the ability to issue aninvitation for bids for supplies electronically.
        (2) Protect the content of an electronic offer to the extentrequired under IC 5-22.
        (3) Provide an authorized user with a secure, accurate report ofall information contained in electronic offers made through thesite on or before the deadline established by the authorized user.
        (4) Comply with IC 5-22.

Equipment and information technology services
    
Sec. 6. The department shall provide the equipment andinformation technology services necessary to operate the Internetpurchasing sites required under this chapter.

Links to Internet purchasing sites
    
Sec. 7. The department shall provide authorized users and thepublic with access to Internet purchasing sites by links to thecomputer gateway administered by the office of technologyestablished by IC 4-13.1-2-1.

Agencies to implement
    
Sec. 8. The following shall cooperate with the department toimplement this chapter:
        (1) The office of technology established by IC 4-13.1-2-1.
        (2) The state board of accounts.
        (3) The attorney general.
        (4) The auditor of state.
