Chapter 5.9. Biweekly Payroll Payments

Procedure
Sec. 1. (a) Notwithstanding any other law, rule, or custom, theauditor of state shall issue payroll warrants or authorizations forelectronic funds transfer under IC 4-13-2-7 to all state employees ona biweekly basis, so that the employees shall receive payment on thesame day of the week, in alternate weeks. The auditor may providefor staggering of payrolls so that payment in the required manner canbe effectively made, in accordance with this chapter.
(b) Should a fiscal year terminate during any biweekly payrollperiod, that portion of the payroll warrant or authorizationrepresenting compensation for services performed during theterminated fiscal year shall be charged against the appropriations forthat fiscal year and that portion of the payroll warrant representingcompensation for services performed subsequent to the terminatedfiscal year shall be charged against the appropriations for the newfiscal year.

Deposit of compensation in employee's account in a financialinstitution; written request by employee
Sec. 2. (a) A state employee may make a written request that anycompensation due from the state be deposited to the employee'saccount in a financial institution. Upon receipt of the request, theauditor of state may:
(1) draw a warrant in favor of the financial institution set forthin the request for the credit of the employee;
(2) in the event more than one (1) employee of the statedesignates the same financial institution, draw a single warrantin favor of the financial institution for the total amount due theemployees and transmit the warrant to the financial institutionidentifying each employee and the amount to be deposited ineach employee's account; or
(3) make a direct deposit to the bank or trust company byelectronic funds transfer under IC 4-13-2-7.
(b) The employee's written request shall authorize in advance thedirect deposit by warrant or electronic funds transfer of theemployee's earnings each time a payroll warrant or electronic fundstransfer is issued on the employee's behalf. The employee's writtenauthorization must designate a financial institution and an accountnumber to which the payment is to be credited. The employee'sauthorization remains in effect until the employee revokes it inwriting.
