Chapter 13. Certain Property Transactions by the Department ofNatural Resources With the United States

Sec. 1. The following statutes apply to a property transactionunder this chapter:
(1) IC 4-20.5-7-3.
(2) IC 4-20.5-7-4.
(3) IC 4-20.5-7-5.
(4) IC 4-20.5-7-6.
(5) IC 4-20.5-7-17.
(6) IC 4-20.5-7-18.

Lighthouse, beacon, or other aid to navigation site; federalacquisition of state property; magnitude; jurisdiction
Sec. 2. (a) This section applies only to state property covered bynavigable waters of the United States.
(b) If an authorized agent of the United States requests theconveyance of state property for the site of a lighthouse, beacon, orother aid to navigation, the state may convey the property to theUnited States.
(c) The property conveyed under this section may not exceed ten(10) acres for a particular transaction requested by the United States.
(d) Subject to subsection (e), the governor may cede thejurisdiction of the state to the United States over property conveyedunder this section.
(e) If the governor cedes jurisdiction under subsection (d), thestate shall retain concurrent jurisdiction with the United States sothat civil or criminal process issued under the state can be executed:
(1) by the proper officers of the state;
(2) upon a person subject to that process;
(3) within the limits of the property ceded; and
(4) in the same manner and to the same effect as if jurisdictionhad not been ceded to the United States.
