"Agency" defined
Sec. 1. As used in this chapter, "agency" refers only to a stateagency (as defined in IC 4-13-1-1).

Duties of department
Sec. 2. (a) This section does not apply to enforcement matters thatare the responsibility of the state police department underIC 10-11-2-28.
(b) The department shall maintain, equip, and operate thefollowing:
(1) The state capitol building.
(2) The office buildings and other property owned or leased bythe state for the use of an agency.

Periodic inspection, appraisal, and inventory; reports
Sec. 3. The department shall provide for the periodic inspection,appraisal, and inventory of all of the state's property, and shallrequire reports from agencies concerning the property in theircustody.

Parking facilities; fees
Sec. 4. (a) The department shall maintain and operate all stateparking facilities.
(b) The department shall assign parking privileges in state parkingfacilities to state officers and employees, and it may assign suchprivileges to other persons.
(c) The department may by rule establish schedules for stateparking facilities under which fees are charged for parking privilegeson a daily, weekly, monthly, or yearly basis. Such a schedule must beestablished so that the fees collected under it do not exceed the costof providing, maintaining, and operating the facilities to which itapplies.
(d) Before a rule is adopted under subsection (c), the departmentshall submit the proposed rule to the budget agency for approval. Thebudget agency may refer the proposed rule to the legislative divisionof the budget committee for an advisory recommendation. If the ruleis referred, the legislative division of the budget committee shall dothe following:
(1) Hold hearings. (2) Exercise any powers under IC 4-12-1-11.
(3) Make an advisory recommendation to the budget agency.
(e) If the department establishes schedules under subsection (c),it shall collect the fees and deposit them in the state general fund oras directed by the budget director.

Custodian of state buildings and grounds
Sec. 5. Except for enforcement matters that are the responsibilityof the state police department under IC 10-11-2-28, the commissioneris the custodian of state buildings and grounds.

Rules
Sec. 7. The department may adopt rules under IC 4-22-2 to governthe protection and custody of state property, except for enforcementmatters that are the responsibility of the state police departmentunder IC 10-11-2-28.

Regulation of state capitol vehicular and pedestrian traffic andparking on or adjacent to property controlled by the state;exception
Sec. 8. (a) This section does not apply to enforcement matters thatare the responsibility of the state police department underIC 10-11-2-28.
(b) The commissioner may regulate:
(1) the traffic and parking of motor vehicles, bicycles, or othervehicles; and
(2) the traffic of pedestrians;
on the streets, roads, paths, and grounds of real property controlledby the state through the department in and around the state capitol,office buildings, parking garages, and adjoining state controlledproperty.
(c) Rules adopted under subsection (b) may include the following:
(1) Provisions governing the registration, speed, weight,operation, parking, times, places, and use of motor vehicles,bicycles, and other vehicles.
(2) Provisions governing the traffic of pedestrians.
(3) Provisions prescribing the assessment and collection of civilpenalties for the violation of rules adopted by the
commissioner. Penalties may include the following:
(A) The imposition of reasonable charges.
(B) The removal and impounding (at the expense of theviolator) of vehicles that are operated or parked in violationof rules adopted by the commissioner.
(C) The denial of permission to operate a vehicle on theproperty in and around the state capitol building, officebuildings, parking garages, and adjoining state controlledproperty.
(d) Rules adopted under this section must include provisions foran administrative appeal when a civil penalty is imposed under therules. A person aggrieved by a final disposition of an appeal by thedepartment may appeal the disposition to a court of jurisdiction. Theattorney general may enforce a civil penalty imposed under thissection by filing an appropriate action in a court of jurisdiction.
(e) This section does not limit or restrict the powers of any othergovernmental authority having jurisdiction over public streets, roads,alleys, or ways.

Code Adam safety protocol
Sec. 9.2. (a) The department shall adopt rules under IC 4-22-2 toestablish and implement a "Code Adam" safety protocol at thebuildings that:
(1) the department:
(A) maintains;
(B) equips; or
(C) operates;
under section 2(b) of this chapter; and
(2) are open to the public.
(b) Rules adopted under this section must include the following:
(1) Procedures for a state employee to follow when a parent,teacher, or guardian notifies the state employee that a child islost or missing. The procedures must:
(A) set forth the information that the state employee is toobtain from the parent, teacher, or guardian concerning thedescription of the lost or missing child; and
(B) identify the person in the department whom the stateemployee is to contact about the lost or missing child.
(2) Procedures for the department contact person identifiedunder subdivision (1)(B) to follow after being notified of thelost or missing child.
(3) Procedures for department employees to follow in searchingthe building in which the lost or missing child is presumed to
be.
(4) Procedures under which department employees will contactlaw enforcement if the lost or missing child is not found.

Construction of fences and bleachers at Evansville State Hospital
Sec. 9.4. The department and the office of the secretary of familyand social services shall establish policies that prohibit theconstruction of fences and bleachers on real property that is part ofthe Evansville State Hospital. This section applies to real propertyused either by:
(1) Evansville State Hospital for recreational purposes; or
(2) an entity using part of the property of the hospital with thepermission of the hospital.

"Robert D. Orr Plaza"
Sec. 10. (a) As used in this section, "real property" refers to thereal property located in Indianapolis bounded by the following:
(1) The east boundary of West Street on the west.
(2) The south face of the state office building located at 100 N.Senate Avenue on the north.
(3) The west boundary of Square 48 and Square 53 of theIndianapolis Donation on the east.
(4) The north face of the state office building located alongWashington Street on the south.
(b) The real property shall be known as "Robert D. Orr Plaza".
(c) The department shall install and maintain the following:
(1) Appropriate public signage on and around the real propertythat displays the name of the real property.
(2) A plaque located at an appropriate spot on the real propertydescribing the highlights of the life and career of Robert D. Orr.

Display commemorating contributions of black citizens of Indianain state capitol
Sec. 11. (a) The department shall commission and place within thestate capitol a permanent display commemorating the contributionsof black citizens of Indiana to:
(1) the state;
(2) other governmental entities; and
(3) the private sector;
throughout the history of Indiana.
(b) The department shall consult with the Indiana historicalbureau to:
(1) identify the individuals whose contributions are to beincluded in the display; and (2) assist in the design of the display.
(c) Not later than July 1, 2008, the department shall submit theplans for the display to the legislative council for approval.
(d) After the legislative council has approved the plans for thedisplay, the department shall have the display constructed and placedin the state capitol.

Bust of President Benjamin Harrison in Indiana state capitol
Sec. 12. (a) The department shall commission and place within thestate capitol a bust of President Benjamin Harrison.
(b) The department shall consult with the Indiana historicalbureau and the Indiana arts commission to assist in the design of thebust.
(c) Not later than July 1, 2008, the department shall submit theplans for the bust to the legislative council for approval.
(d) After the legislative council approves the plans for the bust,the department shall have the bust made and placed in the statecapitol.
