Chapter 12. Indiana Commission for Arts and Humanities inEducation

Creation
Sec. 1. There is hereby created a commission to be known as theIndiana commission for arts and humanities in education. On andafter July 1, 1974, the commission shall consist of eight (8) membersand the state superintendent of public instruction. The eight (8)members shall be appointed by the governor and shall serve for aterm of four (4) years; provided however, that four (4) of thecommissioners who are initially appointed shall serve for two (2)years. In the event of a vacancy, the governor shall appoint asuccessor to complete the unexpired term. In making suchappointments, due consideration shall be given to anyrecommendation made by any other organization concerned with orengaged in arts and humanities in education. Insofar as is practical,members of the commission shall be selected so as to giverepresentation to the various geographical areas of the state and tointerested organizations. The state superintendent shall serve aschairman of the commission.
The meetings of the commission shall be held at leastsemi-annually and at such other times as may be necessary. Allmeetings shall be upon call of the chairman.
The members of the commission shall not be required to devotetheir full time to commission duties, but shall devote such time as isnecessary to carry out said duties under this chapter. Members of thecommission shall serve without pay, but shall be reimbursed for theirreasonable and necessary expenses actually incurred in carrying outtheir duties. Five (5) members of the commission shall constitute aquorum for the transaction of the business of the commission.

Powers and duties
Sec. 2. It shall be the responsibility of the commission to stimulateand encourage arts and humanities programs in the public schools ofthe state.
In furthering this responsibility, the commission shall exercise thefollowing powers, and may establish the necessary procedures,mechanisms and responsible and legal entities to enable thecommission:
(a) To enter into contracts within the limited funds available withindividuals, organizations and institutions for service furthering theobjectives of the commission's program;
(b) To accept gifts, contributions and bequests of funds fromindividuals, foundations, corporations and other organizations orinstitutions;
(c) To make and sign any agreements and to do and perform any
acts that may be necessary to carry out its purpose and duties.

Chief administrative officer
Sec. 3. The chief administrative officer of the commission shallbe the state superintendent of public instruction. He shall makeprovision for office facilities and personnel to keep adequate recordspertaining to the commission's business and may designate aprofessional employee of the department of education as executivesecretary. It shall be the duty of the executive secretary to conductbusiness as directed by the commission.
