Chapter 15. Governor's Residence Commission

Creation; membership
Sec. 1. (a) There is created a commission to be known as thegovernor's residence commission. This commission shall consist ofseven (7) members, who shall each be appointed by and serve at thepleasure and discretion of the governor; and the governor shall be exofficio chairman of the commission.
(b) The commissioners shall each year designate one (1) memberto serve as vice chairman, who shall act as chairman in the absenceof the chairman, and one (1) member to serve as secretary, who shallbe responsible for maintaining records of the proceedings of thecommission, and such other officers as the commission deemsnecessary or desirable.
(c) All contracts, applications for grants, and other documentsshall be executed in the name of the commission either by thechairman of the commission or, when authorized by resolution of thecommission, by the vice chairman, and shall be attested by thesecretary.
(d) The members of the commission shall not be required todevote their full time to their duties, but shall devote such time as isnecessary to carry out their duties under this chapter. The membersof the commission shall serve without pay, but shall be reimbursedfor their reasonable and necessary expenses actually incurred incarrying out their duties.

Duties
Sec. 2. The commission shall have the following purposes andduties:
(a) to provide the governor of the state of Indiana a suitable andfitting residential site located at the seat of state government; and
(b) to make provision to maintain, remodel, expand, finish,refinish, furnish or refurnish, construct or reconstruct such residentialsite either of the existing mansion and any expansion thereof, or anyother acquired site for such governor's mansion, all as may berequired from time to time.

Powers of commission; adoption of design; procurement ofrequired construction
Sec. 3. The commission may also procure and adopt a design forthe erection and construction of such suitable and fitting governor'sresidence, including acquiring such design for any structural changesto the existing or expanded residence or for an acquired site and for
modeling, remodeling, finishing or refinishing, furnishing, orrefurnishing, and the commission may procure the erection,construction, and installation required by such design.

Funds; acquisition of materials
Sec. 4. (a) All money appropriated by Acts 1967, c.180, s.3, andall money received by gift, bequest, or contributions shall not revertto the state general fund at the close of any fiscal year, but remainsavailable for the use of this commission until the provisions of thischapter are fulfilled.
(b) Contracts entered into for the purchase or sale of any materialor supplies, or for the performance of work or labor with moneyappropriated by the general assembly are subject to the bidding,advertising, and bonding procedures of IC 4-13-1.
(c) Acquisitions of materials, furnishings, and supplies, contracts,or work labor are not subject to the bidding, advertising, and bondingprocedures if:
(1) acquired entirely by money received by gift, bequest, orcontribution to the commission; or
(2) directly contributed by any person, partnership, corporation,limited liability company, association, or other organization.

Powers
Sec. 5. In furtherance of its purposes and duties, the commissionshall have, and may exercise the following powers:
(1) To enter into contracts, within the limit of funds availabletherefor, with individuals, corporations, partnerships, limitedliability companies, organizations and institutions for servicesfurthering the objectives of the commission's programs.
(2) To accept gifts, contributions and bequests of funds fromindividuals, foundations, limited liability companies,corporations, and other organizations or institutions to bedeposited in a special account separate and distinct from stateand federal monies.
(3) To apply for, receive and disburse any funds available fromthe federal government in furtherance of the objectives of thischapter and to enter into any agreements which may be requiredby the federal government as a condition of obtaining suchfunds.
(4) To make and sign any agreements and to do and performany acts that may be necessary to carry out its purposes andduties.
(5) To exercise eminent domain.
(6) To make an annual report to the governor and the legislative
council concerning its activities and its recommendations forfuture activities.
(7) To hold, invest and dispense for purposes of thecommission's work, funds received by gift, bequest orcontribution to the commission, and to open and maintainaccounts in the commission's name for said monies withappropriate banks or trust companies. The commission mayrequest the aid of the state board of accounts in establishingthese accounts. Such accounts shall be subject to audit by theboard of accounts.
An annual report made under subdivision (6) to the legislativecouncil must be in electronic format under IC 5-14-6.
