"Commission" defined
    
Sec. 1. As used in this chapter, "commission" refers to the Indianaadvisory commission on intergovernmental relations established bysection 4 of this chapter.

Establishment of commission
    
Sec. 4. The Indiana advisory commission on intergovernmentalrelations is established.

Duties of commission
    
Sec. 5. The commission shall do the following:
        (1) Enhance coordination and cooperation between state andlocal governments.
        (2) Review the effect of any federal or state legislation or anycourt decisions on local governmental entities.
        (3) Act as a forum for consultation among state and localgovernment officials.
        (4) Conduct research on intergovernmental issues.
        (5) Review studies of intergovernmental issues by universities,research and consulting organizations, and entities.
        (6) Issue reports on the commission's activities.

Members representing state government; tenure; powers
    
Sec. 7. (a) The following eleven (11) individuals are the membersof the commission representing state government:        (1) Two (2) members of the senate appointed by the presidentpro tempore of the senate.
        (2) Two (2) members of the senate appointed by the presidentpro tempore of the senate upon recommendation of the senateminority floor leader.
        (3) Two (2) members of the house of representatives appointedby the speaker of the house of representatives.
        (4) Two (2) members of the house of representatives appointedby the speaker of the house of representatives upon therecommendation of the house minority floor leader.
        (5) The budget director or the director's designee.
        (6) The governor or the governor's designee.
        (7) The lieutenant governor or the lieutenant governor'sdesignee.
    (b) A member of the commission who is a member of the generalassembly serves on the commission until the earlier of the following:
        (1) Two (2) years after the date of the member's appointment.
        (2) The date the member ceases to hold the legislative office themember held when appointed to the commission.
    (c) Members listed in subsection (a)(5) through (a)(7) serve termsthat are coterminous with the position or office the member heldwhen the member was appointed to the commission.
    (d) The commission may request a director of a state agency orthe director's designee to provide information to the commission. Adirector or the director's designee shall cooperate with thecommission.

Members representing local governments; tenure
    
Sec. 8. (a) The following thirteen (13) individuals are themembers of the commission representing local governments:
        (1) Four (4) municipal officials, two (2) appointed by thepresident pro tempore of the senate and two (2) appointed bythe speaker of the house of representatives from nominees ofthe Indiana Association of Cities and Towns, who may beselected as follows:
            (A) The mayor of a first class city.
            (B) One (1) member of the legislative body of a second classcity.
            (C) The mayor or a member of the legislative body of a thirdclass city.
            (D) The executive of a town.
        (2) Four (4) county officials, two (2) appointed by the presidentpro tempore of the senate and two (2) appointed by the speakerof the house of representatives from nominees of theAssociation of Indiana Counties. One (1) member appointedunder this subdivision may be a member of a county fiscal bodyand one (1) member appointed under this subdivision may be amember of a county executive.        (3) Two (2) township officials, one (1) appointed by thepresident pro tempore of the senate and one (1) appointed bythe speaker of the house of representatives from nominees ofthe Township Trustees Association.
        (4) One (1) person appointed by the governor who represents aregional or multiple county local governmental entity.
        (5) Two (2) persons, one (1) appointed by the president protempore of the senate and one (1) appointed by the speaker ofthe house of representatives, who may have expertise orexperience in intergovernmental relations.
A member appointed under this section may designate anotherindividual to serve on the commission for the member.
    (b) A member appointed under this section serves on thecommission until the earliest of the following:
        (1) Two (2) years after the date of the member's appointment.
        (2) The date the member is removed by the member'sappointing authority.
        (3) The date the member no longer holds the office or positionthe member held when appointed to the commission.

Vacancies
    
Sec. 8.1. When a vacancy occurs on the commission for anyreason, the appointing authority shall appoint a qualified person tofill the remainder of the unexpired term.

Chairman and vice chairman
    
Sec. 9. (a) The chairman of the legislative council shall select achairman and a vice chairman from among the legislative membersof the commission.
    (b) The chairman and vice chairman of the commission may notbe members of the same political party.
    (c) The commission shall meet at the call of the chairman.However, the commission shall meet at least two (2) times each yearand at other times that the chairman considers necessary.

Voting members; quorum
    
Sec. 10. (a) All members of the commission are voting members.
    (b) Thirteen (13) members of the commission constitute aquorum.
    (c) An affirmative vote of at least thirteen (13) members of thecommission is required for the commission to take action.

Travel expenses
    
Sec. 11. (a) Each member of the commission who is not a stateemployee is not entitled to a minimum salary per diem provided byIC 4-10-11-2.1(b). The member is, however, entitled toreimbursement for traveling expenses as provided under IC 4-13-1-4and other expenses actually incurred in connection with the member'sduties as provided in the state policies and procedures established bythe Indiana department of administration and approved by the budgetagency.
    (b) Each member of the commission who is a state employee butwho is not a member of the general assembly is entitled toreimbursement for traveling expenses as provided under IC 4-13-1-4and other expenses actually incurred in connection with the member'sduties as provided in the state policies and procedures established bythe Indiana department of administration and approved by the budgetagency.
    (c) Each member of the commission who is a member of thegeneral assembly is entitled to receive the same per diem, mileage,and travel allowances paid to members of the general assemblyserving on interim study committees established by the legislativecouncil.

Staff and administrative support; director
    
Sec. 12. (a) Staff and administrative support for the commissionshall be provided by the Indiana University's Center for Urban Policyand the Environment.
    (b) The commission shall select a director for the commission.
