    Chapter 11. Payment of Prizes

Verification of validity of winning tickets; adoption of rules
    
Sec. 1. The commission shall adopt rules under IC 4-22-2 toestablish a system of verifying the validity of tickets claimed to winprizes and to make payment of the prize.

Assignment of prize; restrictions
    
Sec. 2. The right of any person to a prize is not assignable. A prizemay be paid to the estate of a deceased prize winner or to a persondesignated under an appropriate judicial order.

Persons less than 18 years of age
    
Sec. 3. A prize may not be paid to a person who is less thaneighteen (18) years of age unless the winning ticket was lawfullypurchased and made a gift to the minor. In that case the commissionshall direct the payment to an adult member of the minor's family orthe legal guardian of the minor as custodian for the minor. Theperson named as guardian has the same powers and duties asprescribed for a guardian under Indiana guardianship law.

Invalid tickets
    
Sec. 4. A prize may not be paid if it arises from tickets that aredetermined to be:
        (1) stolen, counterfeit, altered, fraudulent, unissued, producedor issued in error, or unreadable;
        (2) not received or not recorded by the commission's applicabledeadlines;
        (3) lacking in captions that confirm and agree with the lotteryplay symbols that are appropriate to the lottery game involved;or
        (4) not in compliance with any additional specific rules andpublic or confidential validation and security tests of thecommission applicable to the particular lottery game involved.

More than one claimant entitled to prize
    
Sec. 5. A particular prize in a lottery game may not be paid morethan once. If there is a binding determination that more than one (1)claimant is entitled to a prize, the sole remedy of these claimants is

the award to each of them of an equal share in the prize.

Maximum payment allowed by retailers
    
Sec. 6. For the convenience of the public, retailers may beauthorized to pay winners an amount not to exceed five hundredninety-nine dollars ($599) after performing validation procedures ontheir premises that are required by the commission for the lotterygame involved.

Deadlines for claiming prizes
    
Sec. 7. Holders of lottery tickets are entitled to claim prizes forone hundred eighty (180) days after the drawing or at the end of thelottery game play in which the prize was won. If a valid claim is notmade for a prize within the applicable period, the prize is consideredan unclaimed prize for purposes of section 9 of this chapter.

Tickets purchased or sold in violation of article
    
Sec. 8. A prize may not be paid on a ticket that is purchased orsold in violation of this article or to a person who is prohibited frompurchasing a lottery ticket under this article. Such a prize isconsidered an unclaimed prize for purposes of section 9 of thischapter.

Unclaimed prize money
    
Sec. 9. All unclaimed prize money shall be added to the pool fromwhich future prizes are to be awarded or used for special prizepromotions.

Sec. 10. The commission is discharged of all liability uponpayment of a prize.

Prize winners with outstanding debt to state agency, delinquenttaxes, or past due child support; offset
    
Sec. 11. (a) The treasurer of state, the department of state revenue,the department of administration, the Indiana department oftransportation, the attorney general, and the courts shall identify to

the commission, in the form and format prescribed by thecommission and approved by the auditor of state, a person who:
        (1) owes an outstanding debt to a state agency;
        (2) owes delinquent state taxes; or
        (3) owes child support collected and paid to a recipient througha court.
    (b) Before the payment of a prize of more than five hundredninety-nine dollars ($599) to a claimant identified under subsection(a), the commission shall deduct the amount of the obligation fromthe prize money and transmit the deducted amount to the auditor ofstate. The commission shall pay the balance of the prize money to theprize winner after deduction of the obligation. If a prize winner owesmultiple obligations subject to offset under this section and the prizeis insufficient to cover all obligations, the amount of the prize shallbe applied as follows:
        (1) First, to the child support obligations owed by the prizewinner that are collected and paid to a recipient through a court.
        (2) Second, to judgments owed by the prize winner.
        (3) Third, to tax liens owed by the prize winner.
        (4) Fourth, to unsecured debts owed by the prize winner.
Within each of the categories described in subdivisions (1) through(4), the amount and priority of the prize shall be applied in themanner that the auditor of state determines to be appropriate. Thecommission shall reimburse the auditor of state pursuant to anagreement under IC 4-30-15-5 for the expenses incurred by theauditor of state in carrying out the duties required by this section.
    (c) As used in this section, "debt" means an obligation that isevidenced by an assessment or lien issued by a state agency, ajudgment, or a final order of an administrative agency.
