Chapter 7. Administrative Procedure

Decision making process; written protest
Sec. 1. IC 4-21.5 applies to the commission's decision makingprocess, except that a formal written protest of any decision, intendeddecision, or other action subject to IC 4-21.5 must be filed withinseventy-two (72) hours after receipt of the notice of the decision,intended decision, or other action.

Termination of contract and certificate of authority of retailer;right to continue operating
Sec. 2. If the commission proposes to terminate the contract andcertificate of authority of a retailer, the retailer may continue tooperate under the certificate of authority until the commission hasmade its decision and all administrative appeals have been exhaustedby the retailer. However, this right to continue to operate does notapply to a retailer if the commission declares in a decision toterminate a certificate of authority that an emergency exists thatrequires the immediate termination of the contract and certificate.
