    Chapter 11. Breed Development Advisory Committees and BreedDevelopment Funds

"Development committee" defined
    
Sec. 1. As used in this chapter, "development committee" refersto a breed development advisory committee established by thecommission under section 3 of this chapter.

Sec. 2. As used in this chapter, "development fund" refers to abreed development fund established by the commission under section10 of this chapter.

Establishment of separate committee for each breed
    
Sec. 3. The commission may establish a separate breeddevelopment advisory committee for each breed of horse thatparticipates in racing meetings under this article.

Members; requirements
    
Sec. 4. Each development committee consists of three (3)members appointed by the governor. The members of eachdevelopment committee must be residents of Indiana who areknowledgeable in horse breeding and racing and must include one (1)member who is an owner and one (1) member who is a breeder. Nomore than two (2) members of each development committee may bemembers of the same political party.

Term of office; vacancy
    
Sec. 5. A member of a development committee serves a term offour (4) years. If a vacancy occurs on a development committee, thegovernor shall appoint a new member to serve for the remainder ofthe unexpired term.

Chairman; secretary
    
Sec. 6. Each development committee may elect one (1) memberto serve as chairman and one (1) member to serve as secretary.

Salary; reimbursement of expenses
    
Sec. 7. A member of a development committee is not entitled tothe minimum salary per diem provided by IC 4-10-11-2.1(b).However, a member is entitled to reimbursement for travelingexpenses and other expenses actually incurred in connection with themember's duties, as provided in the state travel policies andprocedures established by the department of administration andapproved by the budget agency.

Indiana sires racing program
    
Sec. 8. Each development committee shall make recommendationsto the commission concerning an Indiana sires racing program. If thecommission establishes an Indiana sires racing program, only thosehorses that were sired by an Indiana stallion are eligible for racesconducted under the program. Stallions residing in Indiana during thefull length of the breeding season are eligible for registration asIndiana sires. The commission may charge a fee for registration ofIndiana sires.

Recommendations to commission
    
Sec. 9. (a) Each development committee may makerecommendations to the commission concerning:
        (1) stakes races;
        (2) futurity races;
        (3) races only for horses owned by Indiana residents;
        (4) races only for horses sired by stallions standing in Indiana;
        (5) races only for horses foaled in Indiana; or
        (6) races for any combination of horses described in subdivision(3), (4), or (5).
Races described in subdivisions (3) through (6) may be for differentdistances and may be limited by the age, sex, or gait of the horse.
    (b) Each development committee may make recommendations tothe commission concerning:
        (1) cooperative arrangements with statewide breed associations;and
        (2) distribution of money available in a development fund inorder to supplement a purse for a race at a county fair oragricultural exposition in Indiana.

Establishment of separate fund for each breed
    
Sec. 10. The commission may establish a separate breeddevelopment fund for each breed of horse that participates in racingmeetings under this article. The development funds shall be

administered by the commission.

Composition of fund
    
Sec. 11. Each development fund consists of:
        (1) breakage and outs paid into the fund under IC 4-31-9-10;
        (2) appropriations by the general assembly;
        (3) gifts;
        (4) stakes payments;
        (5) entry fees; and
        (6) money paid into the fund under IC 4-33-12-6.

Investment of funds
    
Sec. 12. The treasurer of state shall invest the money in eachdevelopment fund not currently needed to meet obligations of thatfund in the same manner as other public funds may be invested.Interest that accrues from these investments shall be deposited in thefund.

Payments from funds; order; transfer of funds
    
Sec. 13. The auditor of state and treasurer of state shall makepayments from the development funds upon order of the commission.However, the auditor of state and treasurer of state may not transfermoney from one (1) development fund to another development fund.

Reversion of funds at the end of fiscal year
    
Sec. 14. A development fund does not revert to the state generalfund at the end of a state fiscal year.

Purpose
    
Sec. 15. The commission shall use the development funds toprovide purses and other funding for the activities described insection 9 of this chapter.
