Chapter 11. State Employees' Death Benefit

"Board" defined
Sec. 1. As used in this chapter, "board" refers to the board oftrustees of the public employees' retirement fund.

"Dies in the line of duty" defined
Sec. 2. As used in this chapter, "dies in the line of duty" refers toa death that occurs as a direct result of personal injury or illnessresulting from a state employee's performance of the duties of theemployee's job.

"State employee" defined
Sec. 3. As used in this chapter, "state employee" means anemployee of a state agency, except a state educational institution."State employee" does not include a public safety officer whoreceives benefits under IC 5-10-10.

Establishment of program and fund
Sec. 4. The state shall establish and operate a death benefitprogram for the payment of lump sum death benefits to the survivorsof a state employee who dies in the line of duty. The state mayprovide these benefits by purchasing group life insurance or byestablishing a program of self-insurance. If the state establishes aprogram of self-insurance, the state shall establish a fund to bemanaged by the board and funded by such contributions asconsidered necessary by the board. The board shall pay benefits outof the fund established by the state under this section.

Lump sum payment
Sec. 5. The board shall pay a death benefit of fifty thousanddollars ($50,000) in a lump sum to the surviving spouse, or if thereis no surviving spouse, to the surviving children (to be sharedequally) of a state employee who dies in the line of duty.
