    Chapter 6. Discrimination by Contractors and SubcontractorsProhibited

Contract provisions; antidiscrimination clauses
    
Sec. 1. Every contract for or on behalf of the state of Indiana orany of the municipal corporations thereof, for the construction,alteration, or repair of any public building or public work in the stateof Indiana shall contain provisions by which the contractor agrees:
    (a) That in the hiring of employees for the performance of workunder this contract or any subcontract hereunder, no contractor, orsubcontractor, nor any person acting on behalf of such contractor orsubcontractor, shall, by reason of race, religion, color, sex, nationalorigin or ancestry, discriminate against any citizen of the state ofIndiana who is qualified and available to perform the work to whichthe employment relates;
    (b) That no contractor, subcontractor, nor any person on his behalfshall, in any manner, discriminate against or intimidate any employeehired for the performance of work under this contract on account ofrace, religion, color, sex, national origin or ancestry;
    (c) That there may be deducted from the amount payable to thecontractor by the state of Indiana or by any municipal corporationthereof, under this contract, a penalty of five dollars ($5.00) for eachperson for each calendar day during which such person wasdiscriminated against or intimidated in violation of the provisions ofthe contract; and
    (d) That this contract may be cancelled or terminated by the stateof Indiana or by any municipal corporation thereof, and all moneydue or to become due hereunder may be forfeited, for a second or anysubsequent violation of the terms or conditions of this section of thecontract.
