Chapter 10. State Drug Free Communities Fund

"Fund" defined
Sec. 1. As used in this chapter, "fund" refers to the state drug freecommunities fund established by this chapter.

Purpose; composition of fund
Sec. 2. The state drug free communities fund is established topromote comprehensive alcohol and drug abuse prevention initiativesby supplementing state and federal funding for the coordination andprovision of treatment, education, prevention, and criminal justiceefforts. The fund consists of amounts deposited:
(1) under IC 33-37-9-4; and
(2) from any other public or private source.

Administration of fund; costs
Sec. 3. The treasurer of state shall administer the fund. Costs ofadministering the fund shall be paid from money in the fund.

Investment of fund
Sec. 4. The treasurer of state shall invest the money in the fundnot currently needed to meet the obligations of the fund in the samemanner as other public funds may be invested.

Surplus funds
Sec. 5. Money in the fund at the end of a state fiscal year does notrevert to the state general fund.

Applications for grants; comprehensive drug free communitiesplan
Sec. 6. A person, an organization, an entity, a politicalsubdivision, or an agency may receive a grant from the fund forservices or activities included in a comprehensive drug freecommunities plan approved by the commission established underIC 5-2-6-16 by applying to the criminal justice institute.

Coordination with other funding
Sec. 7. A drug free communities plan submitted under section 6of this chapter must show how proposed services will be coordinatedwith, and not supplant, local, state, or federal funding.

Approval of application; disbursements
Sec. 8. If the commission established under IC 5-2-6-16 approvesan application submitted to the criminal justice institute undersection 6 of this chapter, the treasurer of state shall disburse from thefund to the applicant the amount of the grant specified by thecommission and certified to the treasurer of state by the criminaljustice institute.
