    Chapter 13. Law Enforcement Assistance Fund

"Agency" defined
    
Sec. 1. As used in this chapter, "agency" means a state or locallaw enforcement agency.

"Fund" defined
    
Sec. 2. As used in this chapter, "fund" refers to the lawenforcement assistance fund established by section 4 of this chapter.

Sec. 3. As used in this chapter, "officer" means a state or local lawenforcement officer.

Establishment of fund
    
Sec. 4. The law enforcement assistance fund is established toprovide money to agencies to increase the number of officers onpatrol in the community. The fund consists of the following:
        (1) Appropriations made by the general assembly.
        (2) Any other public or private source.

Administration of fund
    
Sec. 5. The Indiana criminal justice institute established underIC 5-2-6 shall administer the fund. Costs of administering the fund:
        (1) shall be paid from money in the fund; and
        (2) may not exceed fifty thousand dollars ($50,000) during anyyear.

Investment of money in fund
    
Sec. 6. The treasurer of state shall invest the money in the fundnot currently needed to meet the obligations of the fund in the samemanner as other public funds may be invested.

No reversion to state general fund
    
Sec. 7. Money in the fund at the end of a state fiscal year does notrevert to the state general fund.As added by P.L.260-1997(ss), SEC.46.

Grants; application; amount; purpose
    
Sec. 8. (a) An agency may apply to the criminal justice instituteto receive grants from the fund under this chapter.
    (b) The criminal justice institute shall approve or deny a grantapplication submitted under this chapter.
    (c) An agency may receive a grant in the amount of one hundredthousand dollars ($100,000) to train, equip, and pay the first three (3)years' salary for one (1) officer. An agency may receive a grant foran amount of up to one hundred thousand dollars ($100,000) topurchase equipment or hire and train persons to permit the agency toincrease by one (1) the number of officers on patrol in thecommunity. An agency may receive more than one (1) grant underthis chapter.
    (d) A grant awarded under this chapter must be used tosupplement funds available to an agency, and an agency may not usea grant to replace funds that the agency would normally spend fortraining, personnel, equipment, and other agency expenses.

Grants; restrictions
    
Sec. 9. (a) Except as provided in subsection (b), an agency maynot receive grants under this chapter if the grant or grants allow theagency an increase of more than five percent (5%) over the totalnumber of officers employed by the agency or on patrol in thecommunity on the date that the agency submits its first applicationfor a grant.
    (b) An agency that employs less than thirty (30) officers on thedate the agency submits its first application for a grant may receivea grant under this chapter only to hire one (1) new officer.

Rules
    
Sec. 10. The board of trustees of the criminal justice institute shalladopt rules under IC 4-22-2 to implement this chapter.
