Chapter 8. Jurisdiction and Miscellaneous Judicial Proceedings

Jurisdiction; general rule
Sec. 1. Jurisdiction: General Rule. An action brought against thecommission, or against the chairman as the chairman, shall bebrought in the circuit or superior court of Marion County unlessotherwise specifically provided in this title.

Jurisdiction restricted
Sec. 2. Jurisdiction Restricted. Except as otherwise provided inthis title, a person shall not bring an action against the State ofIndiana, the commission, the chairman, or the chairman pro tempore,based upon a claim arising from the collection of money received bythe state in connection with the administration or enforcement of aprovision of this title. The consent of the State of Indiana is herebyexpressly withdrawn and denied in such an action and no court shallhave jurisdiction in such an action.

Declaratory judgment
Sec. 3. Declaratory Judgment. The commission shall have theauthority also to initiate, in the name of the State of Indiana on therelation of the commission, an action to obtain a declaratoryjudgment as to the meaning, application, or constitutionality of aprovision of this title or of a rule or regulation of the commission oran order of the commission. The action shall be brought in any courthaving civil jurisdiction within Marion County against a permittee orother person. The proceedings shall conform to the Indiana Rules ofCivil Procedure concerning declaratory judgments.

Judicial notice
Sec. 4. Judicial Notice. A court shall take judicial notice of thesignature of the chairman and of the seal of the commission. A courtshall take judicial notice, also, of a document, paper, record, orinstrument, or copy of these, duly authenticated, as prescribed in therules and regulations of the commission.
